Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 16, Alexandria VA Medical Center The Cancer Care Program, Chief of Staff plans to contract by means other than full and open competition. This document sets forth the justification in purchase request form 2237, # 502-14-1-151-0002. 2.Nature and/or Description of the Action Being Processed: Request approval for payment of survey fees to American College of Surgeons / Commission on Cancer (ACoS/CoC) for tri-annual certification survey. Value of request is $7,500.00. To be awarded as of 10/25/2013. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Survey to be performed on 10/25/2013 for certification through ACoS / CoC for a period of 3 years at a cost of $7,500.00. The Commission on Cancer (CoC) of the American College of Surgeons bas recognized the Multidisciplinary Cancer Program of Alexandria VAMC as offering high quality cancer care. Only one in four cancer programs at hospitals across the United States receives this special approval. It recognizes the quality of our comprehensive patient care and our commitment to provide you with access to all of the various medical specialists 1nvofved in diagnosing and treating cancer. Approximately 70 percent of all newly diagnosed cancer patients in the United States are treated in the more than 1,500 facilities that are accredited by the Commission on Cancer (CoC) of the American College of Surgeons. Accred1tahon of a cancer center is granted only to those facilities that have voluntarily committed lo provide the best in cancer diagnosis and treatment and are able to comply with established CoC standards. 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): American College of Surgeons, Commission on Cancer is the sole provider of certification. Accreditation of our programs is a way to define, measure, quantify, qualify, promote and advance outstanding care for our Veterans that is reviewed by the only accrediting body in the world to visually provide via a certificate, an endorsement of that outstanding care. The ACoS is a scientific and educational association of surgeons that was founded in 1913 to improve the quality of care for the surgical patient by setting high standards for surgical education and practice. The ACoS conducts various programs through its CoC to improve the care of the cancer patient. Established by the ACoS in 1922, the multidisciplinary CoC establishes standards to ensure quality, multidisciplinary, and comprehensive cancer care delivery in health care settings; conducts surveys in health care settings to assess compliance with those standards; collects standardized data from CoC-accredited health care settings to measure cancer care quality; uses data to monitor treatment patterns and outcomes and enhance cancer control and clinical surveillance activities, and develops effective educational interventions to improve cancer prevention, early detection, cancer care delivery, and outcomes in health care settings. The ACoS CoC is recognized as the only American college institution that can give accreditation to a cancer treatment program. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: American College of Surgeons, Commission on Cancer is the sole provider of certification therefore no other offers will be solicited. They are a non-profit, tax-exempt corporation which provides this service to Medical Centers in the US. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: A review of other orders issued by Contracting Activities in NCO 16 shows that the rate being charged is the same for all medical centers. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research reveals that American College of Surgeons, Commission on Cancer is the sole provider of certification. A check of FPDS-NG shows that 27 orders were placed as Sole Source, Only One Responsible Source, with this tax-exempt, nonprofit organization for the procurement of these certifications for Medical Centers throughout the VA during FY 13. Also during FY 13, numerous other Government agencies (DoD, HHS, etc.) made over 50 Sole Source procurements with this entity for this service. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Accreditation of our programs is a way to define, measure, quantify, qualify, promote and advance outstanding care for our Veterans that is reviewed by the only accrediting body in the world to visually provide via a certificate, an endorsement of that outstanding care. The ACoS CoC provides accreditation for VHA cancer treatment programs. In April 1999, it was reported that the Joint Commission would accept CoC accreditation decisions for cancer treatment facilities of cancer hospitals that are affiliated with health plans and health systems applying for accreditation under the Joint Commission's Network Program. CoC accreditation of the Alexandria VAMC cancer treatment program is tied to our Joint Commission accreditation. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A "See Section VI above". 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Alexandria VAMC will continue to research American college institutions that can provide the accreditation necessary and beneficial in treating our cancer patients. Currently the ACoS CoC is recognized at the VHA level as the institution to perform accreditation of VHA cancer treatment programs. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. 13.Approvals in accordance with FAR 6.304 Lonest Bonton, Jr. Date Contracting Officer NCO 16 Supply Product Team (Division II) a.P&C: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
