Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, NCO 12, Great Lakes Acquisition Center, 115 South 84th Street, Milwaukee, WI 53214 2.Nature and/or Description of the Action Being Processed: Approval is requested to award a firm fixed price contract for continued and uninterrupted fire suppression services for the Hines VA Medical Center, Hines IL. The current contract expired November 30, 2013. The proposed interim contract will be for three (3) months to allow the VA sufficient time to award the new Open Market competitive contract. The full base plus four option year solicitation is being processed under transaction 578-14-1-6072-0001. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Edward J. Hines VAMC in Hines, IL has a regulatory need for fire suppression services. The cost of these services are $100,428.00 for the period of performance from 12/1/13 - 2/28/14). 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) Only one responsible source and no other supplies or services will satisfy agency requirements per FAR 6.302-1. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Fire Suppression services are both a vital and essential service provided to the Veteran Patients and employees within the Hines VA Medical Center and it outlying clinics and buildings on the reservation. The service provides fire support for its 3,000,000 enclosed square foot medical center and forty-five building complex which resides on a 170 acre federal reservation. Included are a psychiatric treatment facility, long term care facility, spinal cord injury residential care facility, blind rehabilitation center, out-patient clinics, medical research facilities, a warehouse, engineering shops, supply depot, veterans benefits delivery center, boiler plant, housekeeping quarters, non-housekeeping quarters and administrative offices. Any temporary disruption of services could directly affect patient's health, welfare and safety without first responders to provide response to HazMat incidents, confined space rescue, fire alarms, fire suppression and fire emergency calls. Performance coverage is provided twenty-four (24) hours a day, seven (7) days a week, 365 days a year. The time, cost, tasks and critical response times required will be greatly impacted by temporarily switching contractors to quickly compete a short-term requirement. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The contracting officer has currently completed the market research process to conclude that no services are available on Federal Supply Schedule, with small businesses or SDVOSB or VOSB's and will have to be competed in the unrestricted open market. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost of the continued service is the same as the final option year pricing from the previous contract. The cost will be the current contract price which was determined fair and reasonable by the CO at time of award. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The time, cost, and tasks required to switch contractors on a short-term basis severely restricts any ability to quickly compete a short-term requirement. Vendors on the unrestricted open market will be allowed to compete for the long-term requirement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Regulatory requirement guidance MP-3 Part III Fire Prevention and Suppression for continuity of service. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Village of Forest Park Fire Department, 517 Des Plaines Avenue, Forest Park, IL 60130. 11.A Statement of the Actions, if any, the Agency May Take to Remove or overcome any Barriers to Competition before making subsequent acquisitions for the supplies or services required: The primary step to overcome barriers to competition is focusing on properly competing the longer-term requirement which is the reason a three month short-term contract is being requested. Contractors on the open market will be afforded sufficient time and opportunity to compete for the long-term contract.
