- Justification and Approval (J&A) INTRODUCTION: THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI) Office of Acquisition (OA) on behalf of the Hematology Branch, (HB) Flow Cytometry Core Facility,(FCCF) NHLBI, intends to negotiate and award a purchase order on a noncompetitive sole source basis without providing for full and open competition to BD Bioscience 2350 Qume Dr., San Jose, CA 95131to procure a service contract for a BD FACSAria II Special Order Flow Cytometer Sorter. Procurement: 1. BD FACSAira II Special (no lasers) S/N P650033024 2. Sapphire 200 MW Blue Laser 3. Laser Red Coherent Cube 637-150 4. Laser Violet 405-100 5. To include the following coverage: • The BD FACSAria II Special Order System with one Computer Workstation (excluding printers) • Labor, travel expenses and parts(excluding consumables) • 2 Preventive Maintenance Inspection to be performed during a twelve month period, including 2 PM Kits • Software Revisions released during the agreement term • Unlimited service visits, Monday - Friday, excluding BD Biosciences holidays • Unlimited telephone support for instruments, reagents and applications • Emergency on-site service (Monday through Friday, excluding BD holidays) within 48 hours Background: The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting and supporting medical discoveries that improve people's health and save lives. The Flow Cytometry Core Facility of NHLBI conducts research into the biology of cells using fluorescent markers, imaging, and flow cytometry. The mission of the Flow Cytometry Core Facilities at the National Heart, Lung and Blood Institute is to provide state of the art analysis and sorting of cells using flow cytometry. It is necessary for the ongoing research in cardiology, hematology, and lung diseases. It is especially important that as a core facility we are always able to provide the service of cell sorting in a timely manner in order to prevent any delays of important projects for the numerous laboratories of the National Heart, Lung and Blood Institute. Purpose and Objective: The purpose of this requirement is to procure a Full onsite service agreement offer unlimited on-site repair visit, including parts, labor, and travel expenses during the service agreement coverage. For the optimal results in identifying cell populations determined by using lasers, and the highly complex and sensitive electronics of the BD FACSAria for cell sorting, the Government must have specially trained engineers from Becton Dickinson, the maker of the BD FACSAria, for service and routine timely maintenance to ensure the least amount of downtime of the cytometer. A maintenance contract must provide phone service and prompt service calls by the highly qualified BD engineers, to maximize the uptime and productivity for uninterrupted service to the Institute. Anticipated Period of Performance: December 18, 2013 - December 17, 2015 Justification: See attached Justification and Approval (J&A) Regulatory Authority: This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source, only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION Industry Classification (NAICS) Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance and the Small Business Size Standard is $19.0M. The acquisition is being conducted under FAR Part 13, simplified acquisition procedures, therefore the requirements of FAR Part 6 B Competitive Requirements are not applicable (FAR Part 6.001). The resultant Contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-71(November 25, 2013). This requirement is under the SAT of $150,000.00. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
