Description
Fiscal Service on behalf of the Consumer Financial Protection Bureau (CFPB) intends to issue an order to Smartronix, Inc., 44150 Smartronix Way, Hollywood, MD 20636 via GSA's Alliant Contract No. GS00Q09BGD0050 for Cloud Infrastructure and System Administration Services. The order will issued within the authority of the GSA Alliant GWAC which states that all contract holders must be provided a fair opportunity to be considered for all orders in accordance with FAR 16.505, unless an exception to fair opportunity in FAR 16.505(b)(2)(i)-(iv) applies. An exception to fair opportunity applies to the order in accordance with FAR 16.505(b)(2)(i)(C) which states the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. Smartronix, Inc. (Smartronix) was awarded contract TPDCFP13K0058 on July 1, 2013, as a five month bridge contract to provide Cloud Infrastructure and System Administration Services, to include support to CFPB's Amazon Web Services (AWS) cloud hosting and Terremark data storage environments. The services are vital to CFPB to manage its Cloud Infrastructure, which enables all of CFPB's IT operations. Both AWS and Terremark are vital to supporting the Bureau's day-to-day technology operations, and have a Federal Information Security Management Act (FISMA) Moderate Authority to Operate (ATO), the security level required for all hosting environments housing CFPB data. Currently, Smartronix not only provides the support services, but also owns and manages both the AWS and Terremark environments on behalf of CFPB. CFPB has a continued need for Cloud Infrastructure and System Administration Services, as well as its AWS and Terremark environments. CFPB requires continued support through a follow on bridge contract for a maximum period of performance of eight months, consisting of a six month base period and two one month option periods. This follow-on contract is to allow for up to eight additional months of support which will enable CFPB Procurement to execute a Cloud Infrastructure and System Administration Services contract as well as to separately execute both the AWS and Terremark portions of this bridge, enabling CFPB, through resellers, to own and control both of these accounts. If this bridge is not in place by the time the current contract expires on 12/31/2013, the Bureau's AWS and Terremark accounts will be suspended, meaning CFPB's internal and external websites and all mission critical applications running in these environments will be shut down and its day-to-day internal IT operations will be suspended, as these operations rely on data stored in Terremark to function. Additionally, since Smartronix owns CFPB's AWS and Terremark accounts, CFPB will not be able to reactivate its accounts without transitioning the accounts from Smartronix's respective parent accounts. Additionally, a lapse in the Cloud Infrastructure and Administration Services will result in extended delays in rebuilding CFPB's Cloud Infrastructure, as CFPB's system administration employees are unable to take on these additional duties. An acquisition package for the Cloud Infrastructure and Administration Services was submitted on November 1, 2013 to the CFPB procurement team and is currently being worked. The intent is to have an award made before the end of this bridge with enough time (60-90 days) to ensure effective transition of these services, to be provided under this bridge, to the successful offeror. Concurrently, acquisition packages that will promote competitive procurements for both the AWS and Terremark requirements were submitted to CFPB procurement (November 1, 2013). These requirements will allow CFPB to own and control both of these accounts, thus allowing for more insight and control of these environments. At this time, Smartronix is the only responsible source from which to procure the existing Cloud Infrastructure and Administration Services, to include both AWS and Terremark, particularly because they are not only currently providing these services, but also the management and ownership of CFPB's AWS and Terremark environments are both currently owned by Smartronix. The services being provided by Smartronix are integral to email and Blackberry server support, back up and disaster recovery, and engineering support. These services are also required to successfully migrate the Bureau's IT infrastructure from DO's. The process to migrate these accounts depends on a number of variables including resource availability, amount of data storage, access controls, and licensing provisioning, all of which have to be collaboratively discussed and agreed to with the relevant parties. CFPB cannot transition the data out of AWS and Terremark to other cloud environments because no other comparable cloud or data storage environments have been given a FISMA Moderate ATO from CFPB. Such accreditation would take at least nine to twelve months, but will be unnecessary for AWS and Terremark, as each entity's individual ATO stays with that service regardless of the provider or reseller. The replacement contracts for AWS and Terremark, once awarded, will allow CFPB to transition its AWS and Terremark environments off of this bridge to the successful offeror(s). Including both AWS and Terremark in this bridge for the maximum time of up to eight months avoids an interruption in services to either AWS or Terremark which would result in a cessation of all of the Bureau's IT functions and its public-facing website (www.consumerfinance.gov). Replacing Smartronix during this critical period of time would be significantly disruptive and inefficient, leading to setbacks in the project which would result in unacceptable delays and increased costs to Treasury and CFPB for additional and continued support. The period of performance for this bridge contract is the amount of time necessary for the CFPB Procurement Team to complete three procurements (one for AWS, one for Terremark, and one for Cloud Infrastructure and Administration Services) and to allow for an orderly transition of the services, AWS and Terremark. As noted herein, acquisition packages for the follow-on procurements are with the CFPB Procurement team for execution. NO SOLICITATION IS AVAILABLE. A request for more information, or a copy of the solicitation, will not be considered an affirmative response to this Special Notice.
