- This justification is provided to support contracting without full and open competition for subject requirement as authorized by the test program for commercial items (Section 4202 of the Clinger-Cohen Act of 1996), Federal Acquisition Regulations (FAR) 13.501.MSC Norfolk has a requirement to award a contract for the USNS ZEUS (T-ARC 7) to upgrade its High Precision Acoustic Positioning System 500 (HiPAP) from the HiPAP 500 to the HiPAP 501 version and to purchase the Conversion Kit 501 to 101 for the deep water/low frequency portion of the HiPAP system due to technical obsolescence of the existing HiPAP 500 system using other than full and open competition. Rationale Supporting Use of Authority Cited Above: Kongsberg Maritime, Norway, is the Original Equipment Manufacturer (OEM) for the existing High Precision Acoustic Positioning and Underwater Navigation System 500 (HiPAP) onboard the USNS ZEUS (T-ARC 7). The installed HiPAP 500 system is proprietary to Kongsberg Maritime. The Government was advised by Kongsberg, via a letter dated 9 October 2013, that the current system transceiver (500 version) is no longer supportable due to aging and non-availability of electrical components. To improve the reliability of the system and ensure that the vessel is capable of meeting mission requirements, the resource sponsor has requested that the existing HiPAP 500 be upgraded to the latest 501 version from Kongsberg Maritime. Replacing the entire HiPAP 500 would require extensive market research to determine what systems may be available, and which would meet the requirements for the vessel's operations with ROVs. Additionally, this would involve dry-docking the ship for an extended period of time to remove existing hull units and transducer heads and replacing the current HiPAP 500 system with an unknown new system. This would be significantly more expensive than upgrading the electronics of the HiPAP 500 transceiver and converting the deep portion/low frequency of the HiPAP 501 system with the HiPAP 101 system.
