Description
Below please find the National Park Service's (NPS) response to the remaining question and correspondence submitted in regard to the Prospectus for a Concession Business Opportunity to provide lodging, retail, food and beverage and other services (CC-GRCA001-15). Please note all potential Offerors should read the questions and responses for both CC-GRCA001-15 and CC-GRCA003-15, as there is some information in each that may be of assistance in preparing a proposal to either solicitation. 1. Based on the provisions in 16 USC 5954(a)(4), the current prospectus, and NPS Federal Register notices in connection with solicitations for Shenandoah and Signal Mountain Lodge concessions, it appears that NPS is using an alternative formula for LSI valuation under the current prospectus. Please confirm that in accordance with 16 USC 5954(a)(4), if no responsive offer is received in response to the current prospectus, the concession opportunity will be re-solicited with the LSI value as described in paragraph (a)(3) of 16 USC 5954. It is premature to announce how the NPS might restructure the prospectus if no responsive offer is received to the current prospectus. In the event of a resolicitation, the NPS may restructure any terms of the prospectus as permitted by law. 2. The Proposal Instructions state that the NPS will respond to any submitted questions in writing and will provide the questions and responses to all potential Offerors who have requested a Prospectus. During this solicitation, the NPS received a letter that did not contain an express question but did criticize the NPS for allocating many assets and their associated LSI that had previously been assigned to the GRCA001 Contract to the Draft GRCA003 Contract. The writer alleged that allocating approximately $50,000,000 in LSI to the Draft GRCA003 Contract (when its predecessor had no LSI) made the smaller South Rim contract uncompetitive (because the offeror would have to pay the holder of the LSI its value as part of the initial investment). Note: the NPS total estimated initial investment is $49,885,579, which includes the LSI of $41,161,579. The NPS's primary motivations for realigning the services and associated assets were to create efficiencies at some locations, like Desert View, and to create an opportunity for healthy competition for lodging and dining in the South Rim Village. The NPS believes that visitors would benefit greatly from more diversified offerings and competition among concessioners on the South Rim. Realigning the services and associated assets did add initial LSI to CC-GRCA003-15 where under the Existing Contract there is none. The intention was not to put it out of reach of smaller companies, but rather to create a more robust portfolio of services with a strong opportunity for profit that would enhance competition.
