- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (J&A) TO: Veronica Moss Contracting Officer M/CIO/PAD/AM FROM: Bruce Wierzechowski Contracting Officer’s Representative M/CIO/IA/SO 1. This document sets forth the facts and rationale justifying the use of other than full and open competition, in accordance with FAR 6.302-2(b)(2), unusual and compelling urgency. USAID, M/CIO/IA/SO has IT hardware equipment requirements to be purchased by USAID, M/CIO/PAD/AM on a sole source basis from General Dynamics (GD) C4 Systems Inc. This purchase is an upgrade to General Dynamics Taclane encryptors purchased previously and used between USAID and the Dept. of State (DOS) on ClassNet. The purchase is a rush because it impacts the Secure Passive Optic Network (S-PON) implementation schedule of another contractor in coordination with DOS. The order was placed Aug. 23 because the delivery schedule has slipped, with delivery now scheduled for 90 days from the date of award. 2. The nature and/or description of the action being approved. The purchase is for 8 KG175G model Taclane encryptors for the USAID CIO to replace 8 older model KG175D Taclane encryptors, which are to be traded in; 3 steel rack mount kits; and maintenance and help desk support for 5 years by Secret cleared personnel. The equipment will be delivered to the main DOS site in Washington, DC and transported to the secure DOS site in Lorton, VA. There is no other source that can provide the KG175G Taclane encryptors. The maintenance and help desk support is being forward funded for 5 years as a new program costing less than $2M in accordance with ADS 602, Forward Funding, Program Funds, Subpart 602.3.3(c). This is a bona fide need as USAID requires the operational readiness of the equipment and requires Secret cleared personnel with an understanding of the DOS and USAID Secret IT environment and ClassNet. DOS and USAID cannot risk any downtime for the equipment or any funding irregularities from year to year. 3. Description of the supplies or services required, including an estimated value. See the response to #2 above. The firm fixed price for the equipment and services is $112,485. 4. Statutory authority permitting other than full and open competition. The statutory authority for FAR 6.302-2(b)(2), only one responsible source, is 41 U.S.C. 253(c)(2). 5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition that requires use of the authority cited. The Taclane micro encryptor is a Controlled Cryptographic Item (CCI). The National Security Agency (NSA) must approve the sale of CCI items. The Government technical point of contact’s name, phone number and email address must be provided to the source prior to the sale. NSA must verify the technical point of contact and approve the sale before it is finalized. General Dynamics C4 Systems Inc. is the only source for the items required in this purchase. 6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) 5.202 [AIDAR 705.002]. General Dynamics C4 Systems Inc. is the only source for the Taclane encryptors needed by USAID and DOS. See the response to #5. This purchase was not synopsized prior to award but will be posted in FedBizOpps following approval of the J&A. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. Taclane encryptors were bought in July 2012 from General Dynamics for $9,900 each but they did not include the extra features of the Taclane encryptors in this purchase, the 5 years of maintenance and help desk support, or a price discount for trading in older model encryptors for the current model version. The price is seen as fair and reasonable for a sole source, all price and non-price factors considered. The items are not available on a GSA schedule contract or GWAC. There is no price premium that can be paid to expedite delivery of the order. 8. Description of the market research conducted, and the results or a statement of the reasons market research was not conducted. See the response to #5 above. 9. Other facts supporting the use of other than full and open competition. N/A. 10. Sources, if any, that expressed an interest, in writing, in the acquisition. The only source that expressed an interest in writing is General Dynamics C4 Systems Inc., which provided a quote which was used to make the purchase. 11. The actions the Agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. In order to overcome any barriers to competition, it would depend on NSA to clear any other CCI sources for the encryptors that would access the ClassNet between USAID and DOS. 12. Technical or requirement personnel certification. In accordance with FAR 6.303-2(b), I hereby certify that the technical statements included above and which form a basis for the justification are complete and accurate.
