- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Justification and Approval 1. The Office of Acquisition Management is conducting this acquisition for LSCN Guardian Desktop Fingerprint Scanners for DS Law Enforcement System (LES) ON BEHALF OF Bureau of Diplomatic Security. 2. 2. Nature and/or description of the action being approved The U.S. Department of State (DOS) Office of Acquisitions Management (AQM) intends to award a sole source contract to Cross Match Technologies, 3950 RCA Blvd Suite 5001, Palm Beach Gardens, FL. 33410 for the procurement of the LSCAN Guardian USB Laptop Fingerprint system. 3. A description of the supplies or services required to meet the Department's needs. For purchase of 44 LSCAN Guardian USB Laptop Fingerprint Scanners, associated maintenance and support, the components of the system are as follows: Pelican case 1560 (44 each), Software, LSMS Configuration, JABS/CAS, One year limited warranty for media included (44 each), Software, CMT File Copy Submission with Service (44 each), Implementation, LSMS, First day On-site (2), Implementation and Training, Subsequent Day on-site (8), the LSCAN Guardian USB with LSMS on laptop, Guardian USB Fingerprint scanner (500ppi) with manual, Runtime License for LSCAN, Essential drivers, Autocapture and Roll Licenses, Laptop computer, Live Scan Management Software (LSMS), LSMS Manual Set, Silicone Membrane Supply Kit, PC Anywhere software, Power cord and USB cable, Standard one-year warranty. 4. An identification of the statutory authority permitting other than full and open competition. FAR 8.406.5 Limiting sources 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority Cross Match continues to set the global standard for civil and defense ten-print scanning applications with the next generation Guardian line. With a revolutionary new user interface, enhanced optical design, and more flexible capture modes, the new Guardians provide a completely self-guided ten-print fingerprint capture process that represents a new level of adaptability to real world use. The Guardian's new intelligent user interface and screen intuitively prompt a user through all necessary steps by indicating finger sequence, placement, and pressure; correcting typical mistakes and ensuring the rapid and accurate capture of high quality records every time. The scanner incorporates FlexFlat TM and FlexRoll TM capture modes, providing a more user-friendly way to capture both flat and rolled fingers anywhere on the platen. In addition, a new optical design allows for high quality image capture regardless of whether a subject's hands are wet or dry. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A Limited Source Justification will be posted on the Federal Business Opportunities website. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. GSA has already determined the prices of supplies and fixed-price services to be fair and reasonable. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. The Contracting Office has identified the following firm through an internet search, ATS, Zvetco Biometrics, Bayometric, FulcrumBiometrics, M2SYS Accelrated Biometrics and Corporate Screening. None of the firms mentioned are able to provide the particular CrossMatch LSCAN Fingerprint USB Laptops nor provide for interoperability between their systems and the LSCAN's system. 9. Any other facts supporting the use of other than full and open competition. The LSCAN system software and hardware configuration are unique. Cross Match Technologies is the author of the LSCAN software used to operate the system and does not authorize third parties to provide new equipment or upgrades to the LSCAN system. Implementing a new solution would create an unacceptable risk level. The Government would incur excessive cost for new hardware, software, training and maintenance that would not be covered through competition. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. Cross Match Technologies, 3950 RCA Blvd Suite 5001, Palm Beach Gardens, FL. 33410 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Until DS decides to unroll a whole new product/platform or solution, or other companies insure that their systems can provide for interoperability between the different systems a Limited Source Justification an Approval will be required to procure the LSCAN system through Cross Match Technologies.
