- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written (formal) solicitation will not be issued. This solicitation is issued as a Request for Quotation, (RFQ), solicitation number FA7000-13-T-0071, in accordance with FAR Parts 12 & 13. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-69 effective 1 August 2013. The North American Industry Classification System Code (NAICS) is 333415 and the business size standard is 750 employees. This is a 100% total small business set-aside. All responsible sources may submit a quote, which if received timely, will be considered by the 10th Contracting Division, USAF Academy (USAFA). Please read and comply with all requirements for submitting a quote. Failure to comply with all instructions contained within this combined synopsis/solicitation could result in the quote being ineligible for award. It is the offeror's responsibility to ensure their quote meets all the requirements identified herein. Buy American Act and certification of compliance is required and must be submitted with quote. 0001 Liquid Nitrogen Generator Qty: 1 TOTAL PRICE ___________________ Salient Characteristics - Must produce at least 60 liters of liquid nitrogen per day - Must have a Dewar capacity of at least 210 liters - Overall footprint must not exceed 6.5 feet x 6 feet - Must be able to work at an altitude of 7500 feet - Must have a warranty on all parts and workmanship for 3 years or 8,000 hours - Must include a filter bank assembly to separate the nitrogen from the air we breathe and produce minimum 98% pure nitrogen - The filter bank assembly must be easy and affordable to maintain - Local operator must be able to perform most routine maintenance on site - Must include tools, some spare parts and manual for installation and service - Must include automatic liquid nitrogen level indicator - Must automatically enter into standby mode when the product Dewar is full - Must include cryogenically insulated extraction line and valve for low loss of liquid nitrogen during transfer - Must include a helium compress that is air cooled - Must have floor stand for nitrogen generator assembly - Must include liquid nitrogen plant equipment service kit The following Federal Acquisition (FAR) clauses apply to this combined synopsis/solicitation and offerors must comply with all instructions contained in FAR 52.212-1, Instructions to Offerors--Commercial Items, addenda applies: The contractor shall submit their quote on company letterhead to include the following: solicitation number, contact name, address, telephone number of the offeror, total price, any discount terms, delivery terms, cage code and DUNS number along with projected delivery date. Quotes, including descriptive literature must be received no later than 2:00 pm Mountain Standard Time (MST), 10 September 2013 at the 10 CONS/LGCB office,USAFA, CO 80840. Please submit quotes by e-mail to Lisa Dominguez at elizabeth.dominguez.2@us.af.mil Addenda to FAR 52.212-1, PROPOSAL PREPARATION INSTRUCTIONS: a. Initially, quotes will be evaluated on a technical pass/fail basis that can meet or exceed the salient characteristics. b. Quotes that have passed will then be ranked according to price. The offeror who submits the lowest evaluated price and meets or exceeds the salient characteristics will receive the award. The award will be made to that offeror without further consideration of any other offerors. c. Offerors must submit data that adequately demonstrates that its product meets or exceeds the salient characteristics of the purchase description of the solicitation. A general statement of compliance or restatement of the salient characteristics is insufficient. An offeror shall include in their quote descriptive literature such as illustrations, drawings, or a clear reference to information readily available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. If an offeror cannot comply with every requirement, that offer will not be considered. d. Prices quoted must be Firm-Fixed Price, to include shipping and handling charges based on F.O.B Destination. Quotes received with FOB: Other than Destination will not be considered. Delivery is FOB Destination to USAF Academy, CO 80840. e. The provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (Alt I), must be completed. Offerors are highly encouraged to complete all representations and certifications electronically on line at https://www.sam.gov/portal/public/SAM/. If not completed on-line, 52.212-3 shall be completed in hard copy and submitted with quote. e. DFARS 252.225-7000, Buy American Act-Balance of Payments Program Certificate must be completed, signed and returned with quote. The certificate can be obtained at http://farsite.hill.af.mil/. In accordance with FAR 52.212-4(t), the Contractor is responsible during performance and through final payment of any contract for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. No contractor can be awarded to any company without this registration. The provision at FAR 52.212-2, Evaluation--Commercial Items applies to this acquisition 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor shall be used to evaluate offers: Award will be made on the basis of determining offerors who meet or exceed the salient characteristics listed in the purchase description USAFA PD 34 TRW/SDCU 400-08 dated 15 February 2011 on a pass/fail basis and those offerors who pass (meeting salient characteristics of the purchase description) will then be evaluated on who offered the lowest evaluated price. If an offeror does not meet the salient characteristics, it will not be considered. The offeror must submit data that adequately demonstrates that is products meets or exceeds the salient characteristics. Once an offer has been determined to meet the salient characteristics (passed) then the offeror with the lowest evaluated price will be awarded the contract. A general statement of compliance or restatement of the salient characteristics is insufficient. ADDENDUM TO FAR 52.212-4(c) CHANGES Text in paragraph (c) is deleted and replaced with the following: Changes in terms and conditions of this contract may be made only by written agreement of the parties with the exception of certain changes such as administrative changes including changes in paying office, appropriation data, etc. authorized by the Federal Acquisition Regulation and its supplements that may be made unilaterally by the Contracting Officer (for a complete list of changes that may be made unilaterally, see FAR 43.103(b)) (End of Addendum) 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (Jan 2013) (DEVIATION) (a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
