- Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the Army Contracting Command - Aberdeen Proving Ground, CCAP-SCN, Natick Contracting Division, on behalf of the Natick Soldier System Center (NSSC), intends to award a firm fixed price purchase order on a sole source basis to: PAPPAS Company Inc. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and no solicitation will be issued; however, any firm that believes it can meet the requirement may give written notification to the Contracting Officer. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirement listed. A determination by the government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. 1. Nature and description of the supplies or services required to meet the agency's needs: The contractor will provide and install (2) Modernfold Acousti-seal #932 full height folding partitions with automatic seals, steel track with trolleys, (2) ADA compliant pass doors, one on each side of center column to divide fitness center gym floor area. 2. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): The fitness center building prime contractor was required to provide submittals for government approval for NFPA 101, class A fire rated folding partition with ADA compliant doors so that he could install concealed structural framing and blocking inside the building wall framing in specific locations required for mounting the selected/approved folding partition before installing the finish wall board. The concealed structural framing and blocking inside the building wall framing is specifically located for mounting the selected/approved Modernfold Acousti-seal #932 folding partition in cooperation with the selected vendor PAPPAS CO, and the Architect which was subcontracted by the fitness center building prime contractor. The selected vendor, PAPPAS Company Inc, has direct knowledge of blocking and framing locations concealed in the fitness center walls, necessary to mount the partition installation hardware, wall brackets and tracks. Modernfold is the only manufacturer providing the Acousti-seal #932 folding partition that worked with the fitness center architect, therefore no other vendors would have the necessary direct knowledge to provide and install the partitions. Additionally, the government benefits from the Warranty remaining in full effect when installed by the approved installer. 3. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: Market research was conducted for vendors within the closest proximity to NSSC which resulted in two vendors providing and installing the Modernfold Acousti-seal #932. The two nearest vendors were PAPPAS CO. and Willco Sales & Service Inc. Due to the architect of the new fitness center working with PAPPAS directly on the design for the required Acousti-seal #932 folding partitions the government must use PAPPAS CO. as the sole source vendor for this requirement. 4. Any other facts supporting the use of other than full and open competition: None 5. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: The government fully intends to compete any future requirements for Modernfold Acousti-seal #932 folding partitions as long as they do not relate to the already installed concealed structural framing and blocking inside the new fitness center. Due to the architect of the new fitness center choosing to work with the specific vendor PAPPAS the government does not have the ability to compete this requirement or any future requirements that relate specifically to the pre-designed location for the installation of the Modernfold Acousti-seal #932 partitions in the new fitness center. 6.
