- Specs 4 Specs 3 Specs 2 Specs 1 Statement of Work This is a Brand Name or Equal Requirement (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation, SB1341-13-RQ-0904 is issued as a request for quote (RFQ). (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69. (iv) This solicitation is 100% Set-Aside for Small Business. NAICS Code: 335129. (v) This combined synopsis/solicitation is for the following commercial item(s): 0001: Furnish New LED lighting fixtures for street lighting, CREE, XSP2 type 2, high efficiency 5700, 101W, 480V, 1 Ph, 60 Hz, with occupancy sensor. Or equal fixture with same specifications. Cree catalog number: BXSP-A-O-2-P-A-V-S-K or approved equal. Qty of 227. 0002: Furnish New LED lighting fixtures for parking lot lighting, CREE, XSP2 type 3, high efficiency 5700, 101W, 480V, 1 Ph, 60 Hz, with field output adjustment (no occupancy sensor). Or equal fixture with same specifications. Cree catalog number BXSP-A-O-3-P-A-V-S-Q or approved equal. Qty of 147. (vi) Description of Requirements: See attached document titled: Statement of Work, Specs 1, Specs 2, Specs 3, and Specs 4. (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. (ix) FAR 52.212-2, Evaluation -- Commercial Items, does not apply to this acquisition. The Government will award a Firm Fixed Price contract resulting from this solicitation to the responsible offeror whose proposal conforms to the solicitation results in the best value to the Government, price and all other factors considered. The additional factor considered will be the offerers ability to supply Brand Name or Equal lighting fixtures to the Government. If the lighting fixtures are deemed technically acceptable, award will be made to the lowest priced offer. (x) The offeror must have completed the Online Representations and Certifications Application (ORCA) which is the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items. Reps and certs must be uploaded to the System for Award Management at www.sam.gov. (xi) FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. (xii) FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items applies to this acquisition. FAR 52.212-6 - Brand Name or Equal (a) If an item in this solicitation is identified as "brand name or equal" the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.
