Description
THIS IS A REQUEST FOR INFORMATION (RFI) BEING RELEASED PURSUANT TO FEDERAL ACQUISITION REGULATION (FAR) PART 10: MARKET RESEARCH. This RFI is issued solely for informational, market research, and planning purposes only. It does not constitute an Invitation for Bid (IFB), Request for Quote (RFQ), or Request for Proposal or a promise to issue an RFQ/IFB/RFP in the future. No solicitation document exists at this time. Issuance of this notice does not constitute any obligation on the part of the Government and is not to be construed as a commitment by the Government, implied or otherwise, to issue a solicitation or award a contract. In addition, respondents are advised that the United States (U.S) Government is under no obligation to pay for any information or administrative cost incurred in response to this RFI. At this time, proprietary information is not being requested, and respondents shall refrain from providing proprietary information in response to this RFI. BACKGROUND: The USACE Nashville District awarded contract W912P5-10-C-0002 in January 2010 for concrete construction of the upstream 9 monoliths of the new 1200 foot long navigation lock landward and adjacent to the existing 600 foot long Kentucky Lock at mile 22.4 of the Tennessee River (Livingston County, Kentucky). PURPOSE: This sources sought is being issued to determine the availability of and identify sources able to provide 720 linear feet/14,112 pound of Stainless Steel Angle 6x6x1/2, hot rolled ASTM - A276, Type 304L that meets the requirements contained under FAR Clause 52.225-21, Required Use of American Iron, Steel, and Manufactured Goods - Buy American Act -Construction Materials. (a) Definitions. As used in this clause- quote mark Component quote mark means an article, material, or supply incorporated directly into a construction material. quote mark Construction material quote mark means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. quote mark Domestic construction material quote mark means the following- (1) An unmanufactured construction material mined or produced in the United States. (The Buy American Act applies.) (2) A manufactured construction material that is manufactured in the United States and, if the construction material consists wholly or predominantly of iron or steel, the iron or steel was produced in the United States. (Section 1605 of the Recovery Act applies.). quote mark Foreign construction material quote mark means a construction material other than a domestic construction material. quote mark Manufactured construction material quote mark means any construction material that is not unmanufactured construction material. quote mark Steel quote mark means an alloy that includes at least 50 percent iron, between.02 and 2 percent carbon, and may include other elements. quote mark United States quote mark means the 50 States, the District of Columbia, and outlying areas. quote mark Unmanufactured construction material quote mark means raw material brought to the construction site for incorporation into the building or work that has not been- (1) Processed into a specific form and shape; or (2) Combined with other raw material to create a material that has different properties than the properties of the individual raw materials. (b) Domestic preference. (1) This clause implements- (i) Section 1605 of the American Recovery and Reinvestment Act of 2009 (Recovery Act) (Pub. L. 111-5), by requiring, unless an exception applies, that all manufactured construction material in the project is manufactured in the United States and, if the construction material consists wholly or predominantly of iron or steel, the iron or steel was produced in the United States (produced in the United States means that all manufacturing processes of the iron or steel must take place in the United States, except metallurgical processes involving refinement of steel additives); and (ii) The Buy American Act (41 U.S.C. 10a-10d) by providing a preference for unmanufactured construction material mined or produced in the United States over unmanufactured construction material mined or produced in a foreign country THIS IS NOT A REQUEST TO PURCHASE THE CONSTRUCTION MATERIAL, but to determine if a Buy American Act compliant construction material is available in the United States.
