Description
J&A For Sole Source UNITED STATES AIR FORCE JUSTIFICATION AND APPROVAL FOR SOLE SORCE Confined Space Simulator Eielson AFB, AK 99702 Upon the basis of the following justification and pursuant to 10 USC 2304(c)(1) and FAR 6.302-1 the proposed contract described below may be awarded without providing for Full and Open Competition. I.Organization: Department of the Air Force, Pacific Command, 354th Civil Engineer Squadron/CEOFP proposes to acquire the items described below with a "Justification for Sole Source". The purchase request number for this requirement is F1U3CF3148A003. II.Nature/Description of the Action Being Approved: The use of other than full and open competition for the acquisition of a Confined Space Trainer. The estimated amount is $_________. III.Description of Supplies/Services: The requirement is to purchase 1 Confined Space Trainer Rescue Simulator model number Fire Command CSB 360 CS to provide a safe and controlled training environment for fire fighters and emergency rescue personnel. The simulator is designed to replicate actual confined spaces, flooding conditions, obscured vision conditions, and multiple rescue situations. IV.Statutory Authority: 10 USC 2304(c)(1) or 41 U.S.C. 253(c)(1) by FAR 6.302-1(c). V.Applicability of Authority: In accordance with FAR 6.302-1, the following conditions preclude competitive full and open competition procurement. WRG Fire Training Simulation Systems Inc. is the only company that has been able to provide an ensemble that meets and exceeds all Eielson Fire Department emergency service requirements and the Eielson Fire Department risk management plan including all current laws and standards as listed below: •The General Duty Clause contained in Section 5 of the US Occupational Safety And Health Act (OSHA) •CFR 910 Occupational Safety And Health Standards •29 CFR Subpart H, Hazardous Materials & Substances 1910-120 Hazardous Waste Operations and Emergency Response •29 CFR Subpart Z, Toxic and Hazardous Substances 1910.1030 Blood borne Pathogens •29 CFR Subpart Z, Toxic and Hazardous Substances 1910.1200 Hazard Communication •29 CFR Subpart E, Emergency Action Plans 1910.38 Emergency Action Plan •29 CFR Subpart I, Personal Protective Equipment 1910-132 General Requirements and Appendix A & B •NFPA 1851-2008 SCAM •NFPA 1500-2007 Fire Department OSHA •NFPA 1581-2005 Fire Department Fire Control Program VI.Efforts to Obtain Competition: WRG Fire Training Systems, Inc. is the only company that provides what is suitable for the needs of Eielson AFB. They have provided similar products to Elmendorf AFB as well as various Air Force bases in CONUS. There is no known equivalent design or company which provides these specialized confined space trainers. All research measures were taken to find a substitute that could meet the specifications set by th Fire Department Risk Assessment but none were discovered. VII.Fair and Reasonable Costs: The Contracting Officer will determine the acquisition cost to be fair and reasonable after receipt and evaluation of the contractor's quote/proposal. The anticipated costs will be considered fair and reasonable on the basis that as the manufacturer of required equipment is before reseller markup, and reasonable quantity discounts have been applied. See Tab 14 for additional information on pricing. VIII.Market Research: Preliminary information shows WRG Fire Training Simulationn Systems Inc. to be the only choice due to cost and level of support they can provide. IX.Other Facts: All confined space certified responders are required to perform and pass an overall certification class, which is meant to bring responders to the minimum levels of knowledge in the operations of confined spaces, monitoring, operations, and rescue. The overall hands on design, conforms to and compliments the training standards and guidelines specifically set forth within The California State Training Officers Association, the National Fire Protection Association Standards for Special Operations, Confined Space Operations & Rescue, Technical Rescue, and First Responders Operations CERT. X.Interested Sources: There are no known companies that offer this product or an equal product specific to our needs. In addition, the intermixing of structural components is not allowed per manufacturer specifications. XI.Steps to Foster Competition: Due to the unique nature and exclusive characteristics of this requirement as discussed in section V and IX, all possible sources sought have been exhausted. At the present time, there are no competitive brand name sources that can meet the government's minimal acceptable needs for this requirement. All the appropriate steps to foster competition were used and resellers where contacted for information. XII.Contracting Officer's Certification: The Contracting Officer's signature on the Justification Review Document is evidence that the Contracting Officer has determined this document to be both accurate and complete to the best of the Contracting Officer's knowledge and belief. XIII.Technical / Requirements Personnel's Certification: As evidenced by their signatures on the Justification Review Document, the technical and requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
