Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplement with additional information in this notice. This announcement constitutes the only solicitation and no other solicitation document will be issued. This solicitation is issued as a Request for Quote number RFQ HSCG44-13-Q-PCZ837. This number is for tracking purposes only. Solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-69. This procurement will be processed in accordance with FAR Part 12. The North American Industry Classification System (NAICS) is 423620. The SBA size standard 100 EMP. Due to this Acquisition being considered to be a Sole Source, Procurement it is not anticipated that the Contracting Officer will receive 2 or more Offers from qualified Small Business Concerns; therefore IAW FAR 19.502-2(a) This IS NOT A Small Business Set-A-Side. Substitutes will NOT be considered for Award. See Justification for Other than Full and Open Competition (JOTFOC) below. The USCG Command, Control and Communication Engineering Center (C3CEN) Portsmouth, VA. 23703 for the purchase of: Open Eye Digital Video Recorders 10 Each located at USCG C3CEN ERF, 2401 Hawkins Point Road, Baltimore, MD 21226. Note: The Government/USCG reserves the right to Award on an All or None Basis that is the Gov may issue a PO Contract to the Offeror that submits the lowest aggregate price rather than issue a PO Contract to each Offeror on the basis of the lowest Quotation on each item. The proposed contract action resulting from this synopsis/solicitation for commercial supplies is the Governments intention to solicit and negotiate with only one source under the authority of FAR 6.302-1 & 13.106-1(b). Interested persons/parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotations/proposals. However, all quotations/proposals received within 5 days after date of publication of this synopsis/solicitation will be considered by the USCG/Government. A determination by the USCG/Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the USCG/Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement, and for informational purposes for future acquisitions. The contractor for this proposed Sole Source contract is: Commercial Technology Group, Inc. Cage Code: 43ZY7. A SAMS/BINCS Contractor Verification Information search was conducted on AUG/15/2013 by the Contracting Officer listed below. This is considered to be a Sole Source Acquisition. See attached Justification for Other Than Full and Open Competition (JOTFOC). The Coast Guard does not own nor can they obtain specifications, drawings, plans or other technical data for this item. Request for drawings/specs will be disregarded. Items are to be new items. Used or Refurbished items are not acceptable. Substitutes proposed will NOT be considered for Award. Any Contractors that are authorized Distributors of Commercial Technology Group, Inc. is encouraged to provide a Firm Fixed Price Quotation IRT this Fed-Biz-Ops Solicitation. The government intends to award a contract resulting from this solicitation to the responsible bidder proposal conforming to the solicitation which will be most advantageous and Best Value to the Government, price and other factors considered. The Required Delivery Date is 30 Days ARO. Unless otherwise stated all items will be required to be shipped to the USCG C3CEN ERF 2401 Hawkins Point Road, Baltimore, MD 21226. *PLEASE NOTE* Interested Offeror's are to provide Firm Fixed Price Proposals with Delivery Information by Aug/26/2013 @ 7:00AM EST. Delivery Information is to include the Shipping Terms the Offeror is proposing, FOB Origin or FOB Destination. Destination is preferred by USCG/GOV. If proposing FOB Origin, provide Shipping cost as a separate line item. If proposing FOB Origin, provide Shipping cost as a separate line item. In accordance with FAR 4.1201 prospective contractors are required to submit annual representations and certifications via the Online Representations and Certifications Application (ORCA) at http://orca.bpn.gov. Please ensure completion prior to submission of your quote. Also note that paragraph (b) of FAR 52.204-8, applies. Justification for Other than Full And Open Competition 1. Agency and contracting activity: The Department of Homeland Security, U.S. Coast Guard Command, Control and Communications Engineering Center (C3CEN). 2. Nature/description of the action being approved: The U.S. Coast Guard C3CEN Electronics Repair Facility (ERF) has a requirement, on a sole source basis, for the purchase of electronic repair and replacement parts to be used in centralized depot repair of U.S. Coast Guard Server networking systems, specifically the OpenEye Digital Video Recorders. C3CEN originally purchased the H series Open Eye Video Recorder Model OE3-HR36012 under contract HSCG23-07-P-TED232. When the final option was exercised the Coast Guard did not purchase the total number of units available. The Coast Guard was not aware at the time that OpenEye had discontinued Model OE3-HR36012 and the upgraded unit was not backward compatible with the existing equipment. In order to maintain the units already deployed in the field, it was decided to purchase ten of the remaining units. 3. Description of supplies/services: A Purchase Request will be issued for the purchase of: ten (10) OpenEye digital video recorders, model number OE3-HR36012, from Commercial Technology Group, Inc. The units requested are exact duplicates of the original servers bought by the USCG. 4. Identification of the justification and the rationale: This statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by FAR Subpart 6.302-1, entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". FAR Subpart 6.302-1 (2)(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components there, of, when it is likely that award to any other source would result in a substantial duplication of cost to the Government. 5. Demonstration that the nature of the acquisition requires use of authority cited: When contract HSCG23-07-P-TED232 was issued, OpenEye (OEM) released the total number of units to Commercial Technology Group (one of Open Eye's authorized distributors). Commercial Technology Group has held the full contract inventory in stock to fulfill the Coast Guard's option requirements as required. The OEM specifications for these items are proprietary commercial property. The Coast Guard did not purchase this information when OpenEye Digital Video Recorders were originally purchased. Adequate item information, documentation, and specifications are not available to develop an appropriate purchase description for full and open competition. Any variances would have a negative impact by impairing these Digital Video Recorders from functioning, which would adversely impact safety and mission performance. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: A Request for Quotation (RFQ) will be posted on Fed Biz Ops for any contractor that feels they can provide these items as specified, to provide a price quote. 7. Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable: This equipment is a COTS off the shelf item that is at the end of life production. The cost to purchase the remaining units from Commercial Technology Group should not exceed the original negotiated amount. The anticipated cost will be the same the General Public would pay for the same items. 8. Description of Market Research: Market research as prescribed in FAR Part 10 was conducted by the Contracting Officer's Technical Representative. The Internet was searched using part numbers and item names for a list of manufacturers/vendors that could provide Open Eye replacement units. The market research showed that only Commercial Technology Group, Inc. replacement parts could meet the minimum technical specifications 9. Any other facts supporting the use of other than full and open competition: This purchase of ten DVR recorders shall be used to maintain the equipment currently deployed on the cutters. Without the spares, the Coast Guard is left with equipment that cannot be repaired and cannot be replaced by the manufacturer. The spares will allow the Coast Guard to maintain the equipment for the full life cycle. Reliable and secure ship-wide video recording capabilities are vital in today's Coast Guard; it is a requirement for the recording of secure electronic data regarding everything from general unit operation to helo operations. Without Open Eye specific repair/replacement parts for these DVR systems, the Coast Guard would have to recapitalize new acquisitions for the entire Coast Guard fleet. 10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition: None at this time 11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for supplies or services required: None at this time 12.
