Attachment 3 FAR 52.212-5 Attachment 2 FAR 52.212-3 SOW for “Performing Research on the Proper Classification of Fireworks Articles” SYNOPSIS/SOLICITATION This announcement is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Part 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; PHMSA is requesting quotes and a written solicitation will not be issued. The solicitation number DTPH56-13-Q-000028 is issued as a request for quote (RFQ). The solicitation document incorporates provisions and clauses in effect through Federal Acquisition Circular FAC 2005-67. The applicable, NAICS code is 541690. The government intends to issue a purchase order in accordance with FAR Part 13, Simplified Acquisitions Procedures. Prospective offerors are responsible for downloading the solicitation and any amendments from FedBizOpps.Gov. The government may award a purchase order without discussions if the Contracting Officer determines that the initial offer is the most advantageous to the Government and discussions are not necessary. I. Description of the Requirement: The Department of Transportation, Pipeline and Hazardous Materials Safety Administration (PHMSA), Office of Hazardous Materials Safety (OHMS) will initiate research to refine the proper classification of fireworks articles. Please see the attached Statement of Work (SOW), for the description of the services to be purchased under this solicitation. II. Submission of Quotes: Quotes must include the following three sections: Section I - Technical Capability: This section must describe the offeror's qualifications, offeror's approach for accomplishing the tasks in the SOW, and the availability of resources to fulfill the requirements in the SOW. Particularly critical to the Government is that the offeror can clearly demonstrate an extensive knowledge and expertise in packaging and chemical research involving the transportation of explosive materials by any mode of transportation (refer to section V "Qualifications" of the SOW). The offeror should only include resumes of the proposed personnel to accomplish the tasks in the SOW. Section II - Past Performance: This section must describe relevant experience in providing the services being sought. The offer must provide a narrative (no longer than two (2) pages outlining the qualifications of performing services similar to the requirements within the statement of work, including titles of research materials, dates, publication and role in performing the research. Also, the offeror must include three (3) references (customers) for whom like or similar services have been performed within the past three years. For each reference, provide: name of reference, point of contact, e-mail address, telephone number, a summary of specific services performed, and dates of performance. Section III - Price: This section must include a cost breakdown for each task. Note: Proposed fully-loaded labor rates must include wages, overhead, G&A expenses, and profit. A quote should be no more than forty (40) pages in length including cover page and resumes of proposed key personnel, 8 ½ by 11 inch paper using font size no smaller than twelve (12) pitch. Quotes must be submitted electronically in PDF format via email to Mr. Eric L. Hilton at eric.hilton@dot.gov and Warren Osterberg at warren.osterberg@dot.gov no later than 5:00 P.M., ET on September 3, 2013. III. Evaluation Criteria: Evaluation Criteria: PHMSA will award a firm-fixed price purchase order to that responsible offeror whose proposal represents the best value after evaluation in accordance with the criteria shown below: 1. Technical Capability: This criterion will be used to evaluate the offeror's qualifications, understanding of the requirements, the logic and reasonableness of the offeror's approach and the immediate availability of the dedicated resources to fulfill the requirements. Particularly critical to the Government is that the offeror can clearly demonstrate an extensive understanding of the scope of the requirement and the ability to demonstrate the qualification in packaging and chemical research involving the transportation of explosive materials by any mode of transportation (refer to section V "Qualifications" of the SOW). 2. Past Performance: This criterion will be used to evaluate the offeror's past performance in supporting similar work as described in the SOW. Only relevant past performance history will be considered. The Government will determine relevance of past performance information based on the similarity of the nature of the previous work to the current requirement, and the currency of the prior work (i.e., within the past three years). 3. Price: The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. The Government will make award to the responsible offeror whose offer conforms to the SOW and presents the best overall value to the Government considering the criteria 1 through 3 above. All factors, 1 through 3 above, when considered together establish a base for selecting the offeror which represents the best value to the Government. Technical Capability is more important than Past Performance. Technical Capability and Past Performance, when combined, are significantly more important than Price. IV. (End of clause) Safeguarding Classified Information (PHMSA January 2011) Pipeline and Hazardous Materials Safety Administration (PHMSA) contractor employees are obligated to protect classified information pursuant to all applicable laws, and to use Government information technology systems in accordance with PHMSA and Department of Transportation (DOT) procedures so that the integrity of such systems is not compromised. Unauthorized disclosure of classified documents (whether in print, on a blog, or on a web site) does not alter the documents' classified status or automatically result in declassification of the documents. To the contrary, classified information, whether or not already posted on public websites or disclosed to the media, remains classified, and must be treated as such by contractor employees, until it is declassified by an appropriate U.S. Government authority PHMSA contractor employees: 1. except as authorized by the Director, Office of Security (M-40), or other authorized DOT officials, and pursuant to PHMSA/DOT policies and procedures, shall not, while using computers or other devices (such as Blackberries or Smart Phones) that access the Web on non-classified Government systems, access documents that are marked classified (including classified documents publicly available on WikiLeaks and other web sites), as doing so risks that classified material will be placed onto non-classified systems. This requirement applies to access that occurs either through PHMSA/DOT or contractor computers, or through contractors' personally owned computers that access non-classified Government systems. This requirement does not restrict PHMSA contractor employee access to non-classified, publicly available news reports (and other non-classified material) that may, in turn, discuss classified material. 2. shall not access classified material unless: -a favorable determination of the person's eligibility for access has been made by the DOT Director of the Office of Security (M-40) or another authorized DOT official, -the person has signed an approved non-disclosure agreement, -the person has a need to know the information, and -the person has received contemporaneous training on the proper safeguarding of classified information and on the criminal, civil, and administrative sanctions that may be imposed on an individual who fails to protect classified information from unauthorized disclosure. 3. shall not shall not remove classified information from official premises or disclose that information without proper authorization. 4. who believe they may have inadvertently accessed or downloaded classified or sensitive information on computers that access the web via non-classified Government systems, or without prior authorization, should contact their information security offices for assistance.
