Description
Past Performance Questionnaire Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is 100% set-side for small business. Reference number N69450-13-T-0503 applies. North American Industry Classification System (NAICS) code 115310 applies and the business size standard is $7,000,000.00. A firm fixed-price contract is contemplated. Parties responding to this solicitation must return all pages of this combined synopsis solicitation with pricing. Offerors shall be registered in ORCA or include a completed copy of the provision at 52.2 12-3, Offerors' Representations and Certifications-Commercial Items with their offer. The Government intends to make a single award. Quotations must be received no later than 1400 EDST on 16 September 2013. Quotations must be in writing (Word document PDF) and must be emailed to the following: sarah.deperi@navy.mil. This procurement is being processed under FAR Part 12, Acquisition of Commercial Items. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: EVALUATION FACTORS FOR AWARD Offerors will be evaluated on Price, technical capability, and past performance. 1. Price. Lowest price, technically acceptable source selection process is appropriate for this award as the best value. 2. Technical Capability. Technical capability will be determined solely by submission of a quote and subsequent government evaluation of: • Available contractor equipment as requested in Statement of Work # 1320828. • A performance guarantee listing the percentage of surviving seedlings and the percent of those seedlings which are free to grow one year after planting. 3. Past Performance. An offeror's past performance information will be used to make a determination of whether the offeror has a satisfactory record of past performance. Provide performance history and reference for up to three prior, similar contracts performed with the past three years. Past performance information should be provided on the attached "Contractor Performance Evaluation Survey." A copy should be sent to your customers meeting the criteria stated above. Please ask them to submit a completed copy directly to sarah.deperi@navy.mil. In the event of non-Federal Government contracts then state, local, or commercial contracts should be evaluated in that order. Offerors shall ensure the past performance information requested is submitted in the required timeframe or shall affirmatively state that it does not possess relevant past performance information. In such cases, the offeror's past performance will be rated as neutral. The Government reserves the right to contact previous customers and to obtain additional past performance information as necessary to evaluate offeror's past performance. The assessment of the Offeror's past performance will be used as a measure of performance risk for this contract award. The assessment of the offer s past performance will be used as a means of evaluating the relative capability of the responder and other competitors to successfully meet the requirements of the RFP. Technical capability and past performance, when combined, are approximately equal to price. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (2) "United States" means the 50 States, the District of Columbia, outlying areas, and the outer Continental Shelf as defined in 43 U.S.C. 1331. (End of clause) FAC 5252.201-9300 CONTRACTING OFFICER AUTHORITY (JUN 1994) In no event shall any understanding or agreement between the Contractor and any Government employee other than the Contracting Officer on any contract, modification, change order, letter or verbal direction to the Contractor be effective or binding upon the Government. All such actions must be formalized by a proper contractual document executed by an appointed Contracting Officer. The Contractor is hereby put on notice that in the event a change in work to be performed or increases in the scope of the work to be performed, it is the Contractor's responsibility to make inquiry of the Contracting Officer before making the deviation. Payments will not be made without being authorized by an appointed Contracting Officer with the legal authority to bind the Government. FAC 5252.209-9300 ORGANIZATIONAL CONFLICTS OF INTEREST (JUN 1994) The restrictions described herein shall apply to the Contractor and its affiliates, consultants and subcontractors under this contract. If the Contractor under this contract prepares or assists in preparing a statement of work, specifications and plans, the Contractor and its affiliates shall be ineligible to bid or participate, in any capacity, in any contractual effort which is based on such statement of work or specifications and plans as a prime contractor, subcontractor, consultant or in any similar capacity. The Contractor shall not incorporate its products or services in such statement of work or specification unless so directed in writing by the Contracting Officer, in which case the restriction shall not apply. This contract shall include this clause in its subcontractors' or consultants'agreements concerning the performance of this contract. FREEDOM OF INFORMATION ACT (FOIA) UNIT PRICES Contractor unit prices, when incorporated into a Government contract, will be released under the Freedom of Information Act (FOIA) without further notice to the contractor submitter. If the Contractor takes issue with the release, it should submit its proposal data with the appropriate legends and explain in detail why such data cannot be released as a public record under the Freedom of Information Act. WARRANTY The contractor shall extend to the Government the full coverage of any standard commercial warranty normally offered in a similar commercial sale provided such a warranty is available at no additional cost to the Government. Acceptance of the standard commercial warranty does not waive the Government's rights under the "Inspection" clause nor does it limit the Government's rights with regard to the other terms and conditions of this contract. In the event of a conflict, the terms and conditions of the contract shall take precedence over the standard commercial warranty. The standard commercial warranty period shall begin upon final acceptance of the applicable material and/or services listed in the Schedule. RAPID GATE The CONTRACTOR is also responsible for obtaining permission and clearance from the appropriate station security personnel to enter and perform required work. Commander, Navy Installations Command (CNIC), has established the Navy Commercial Access Control System (NCACS), a standardized process for granting unescorted access privileges to vendors, contractors, suppliers, and service providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seek access to and can provide justification to enter Navy installations and facilities. Visiting vendors may obtain daily passes directly from the individual Navy Installations by submitting identification credentials for verification and undergoing a criminal screening/ background check. Alternatively, if the vendor so chooses, it may voluntarily elect to obtain long-term credentials through enrollment, registration, background vetting, screening, issuance of credentials, and electronic validation of credentials at the vendor's own cost through a designated independent contractor NCACS service provider. Credentials will be issued every five years and access privileges will be reviewed/renewed on an annual basis. The costs incurred to obtain Navy Installation access of any kind are not reimbursable, and the price(s) paid for obtaining long-term NCACS credentials will not be approved as a direct cost of this contract.
