- THIS IS NOT A REQUEST FOR QUOTATIONS. This is a notice of intent to award a sole source Firm Fixed-Price Contract (FFP). The Food and Drug Administration's Office of Acquisition and Grant Services intends to issue a sole source award to Tobacco Merchants Association of the United States. This will be for a subscription for for full, unrestricted access to the firm's collection of tobacco industry business data, information, and reports available and accessible through their Web site at http://www.tma.org/. On June 22, 2009, President Barack Obama signed into law the Family Smoking Prevention and Tobacco Control Act. This historic legislation granted the U.S. Food and Drug Administration (FDA) the authority to regulate tobacco products. The FDA then established the Center for Tobacco Products (CTP) to regulate the manufacture, marketing, and distribution of tobacco products to protect public health and to reduce tobacco use by youth. CTP oversees the implementation of the Family Smoking Prevention and Tobacco Control Act. Some of the Agency's responsibilities under the law include setting performance standards, reviewing premarket applications for new and modified risk tobacco products, requiring new warning labels, and establishing and enforcing advertising and promotion restrictions. The mission of the Office of Policy (OP), a component of the FDA CTP, is to gather information, analyze and develop policies and initiatives, evaluate outcomes, and to work across CTP Offices and with key stakeholders to identify ways CTP can reduce tobacco use and its harms as quickly and effectively as possible. OP staff includes policy analysts, regulatory counsels, economists, management analysts, and public health analysts with expertise in law, public health policy, government and industry relations, economics, management, evaluation, and medicine. This notice of intent is not a request for competitive proposals. The proposed action is for the purchase of a subscription for which the Government intends to solicit and negotiate with only one source under the authority of 41 U.S.C. 253(c)(1), FAR 6.302-1. The estimated dollar value for this action is not to exceed $140,000. This will result in a contract for a base year with four years. The projected award date is August 15, 2013.
