J&A Attachment 4 - Past Performance Questionaire Attachment 3 - FAR Clauses Attachment 2 - Shipping Instructions Attachment 1- CLIN List PLEASE READ THIS NOTICE IN ITS ENTIRETY INCLUDING ATTACHMENTS BEFORE CONTACTING THE POC WITH QUESTIONS/COMMENTS. THANK YOU. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 [Federal Acquisition Circular [2005-67] (JULY 2013)] and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The solicitation number is HSCG80-13-Q-11013 and is issued as a Request For Quotation (RFQ). The NAICS code is 332911 and the Small Business Size standard is 500 employees. The resultant contract will be awarded using Simplified Acquisitions Procedures in accordance with FAR 13.5. The U.S. Coast Guard Surface Forces Logistic Center (SFLC), Patrol Boat Product Line (PBPL), intends on awarding a non-competitive sole source Firm-Fixed Price purchase order to procure control valves in support of the USCG 110' WPB coastal patrol vessels. USCG is requesting quotations on the following parts (Attachment 1- Parts Spreadsheet): Description for Attachment I Part 1: Description: Control Valve Assembly, with Port Side configuration Manufacturer: Leslie Controls, Inc. Part No. U107963101 Quantity: 10 each. Delivery 154 calendar days from receipt of award. Part 2: Description: Control Valve Assembly, STBD with Starboard Side configuration Manufacturer: Leslie Controls, Inc. Part No. U107963103 Quantity: 10 each. Delivery 154 calendar days from receipt of award. Each item shall be individually packaged, packed and marked in accordance with SFLC Specification SP-PP&M-001 shipping instructions (Attachment 2 - Shipping Instructions). It is the Government's belief that Leslie Controls, Inc. is the Original Equipment Manufacturer (OEM) that possesses the required technical and engineering data, and genuine OEM parts, required to successfully meet this requirement. Substitute part numbers are NOT acceptable. It is the Government's intention to solicit and negotiate solely with Leslie Controls, Inc. Concerns having the expertise and required capabilities to provide these items are invited to submit complete information discussing the same within two (2) calendar days from the day this notice is posted. The information submitted must include a letter from the OEM verifying the vendor is an authorized distributor, and verifying the OEM will supply only genuine OEM parts. A copy of the Justification for Other than Full and Open Competition (J&A) is attached. Vendors interested in providing a quotation should submit one to the POC of this notice by email. Along with your quotation, vendors are required to provide their DUNS and tax ID. The closing date and time for receipt of quote is _August 9th, 2013_, at _12_ p.m. Eastern Standard Time. Vendors shall submit the following with their quotation: 1) Complete Attachment 1 - Parts Spreadsheet 2) Forward Attachment 4, Past Performance Questionnaire, to at least two past performance references for which the vendor has supplied Leslie Controls parts. The contract must have been with a Government entity or a commercial business, and within the last 5 years. The Past Performance Questionnaires must be signed by the reference POC, and submitted with the vendor's quotation. 3) DUNS and tax ID 4) Be registered with the System for Award Management or include a copy of its Representations and Certification 5) Complete the disclosure for HSAR 3052.209-70 A formal notice of changes, if applicable, will be issued in FedBizOpps (www.FBO.gov) via amendment(s). It is each vendor's individual responsibility to monitor the FBO system for changes. FAR PROVISIONS AND CLAUSES The following FAR Clauses and Provisions apply to this solicitation. FAR 52.212-1, Instructions to Offerors- Commercial Items (JULY 2013) 52.212-2 -- Evaluation -- Commercial Items. (JAN 1999) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Past Performance Award shall be made on the basis of the lowest evaluated price of quotes that are found technically acceptable. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Copies of CGAP clauses may be obtained electronically at: http://www.uscg.mil/directives/cim/4000-4999/CIM_4200_19J.pdf NOTICE FOR FILING AGENCY PROTESTS United States Coast Guard Ombudsman Program It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman. Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester's concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).
