Description
The Department of Justice (DOJ), Criminal Division, intends to negotiate and award a sole source purchase order with Management Analysis Inc. for continuation of highly important Acquisition Support & Strategy Development International Forfeiture Support Services Contract. DOJ Criminal Division's Asset Forfeiture Money Laundering Section (AFMLS) has primary responsibility for the fulfillment of the Department's asset forfeiture and anti-money laundering enforcement efforts. The proposed purchase order will maintain continuity to provide Acquisition Support and Strategy development services to AFMLS for the International Asset Recovery requirement. Presently, the aforementioned services are being provided to Criminal Division through Management Analysis Inc. under the GSA MOBIS Schedule. The primary contract expired on July 31, 2013 and must be renewed. The services of Management Analysis Inc. are required to continue the support for Acquisition & Strategy Development International Forfeiture Support Services Contract. The period of performance for the purchase order will be approximately one year beginning around Aug 1, 2013 through July 31, 2014. The Department of Justice (DOJ) and the Criminal Division-Asset Forfeiture Money Laundering Section (AFMLS) have a bona-fide requirement for an International Forfeiture Support Services Contract to support DOJ, Treasury and Homeland Security agencies involved in federal seizure and forfeiture activities. This will be a Multiple Agency Contract solicitation designed to be available to Treasury/DHS and DOJ forfeiture program investigative agencies as well as prosecutors and USMS or Treasury/DHS property custodians. The International Forfeiture Support Services contract will include but will not be limited to support for officials who seek to investigate, restrain, forfeit and liquidate illicit assets located abroad under strict requirements the government places on international law enforcement activities. Due to the amount of work and needed expertise AFMLS requires contractor support during the pre-award phase of this requirement. Management Analysis Inc. is the only source that can seamlessly perform the required critical services for the Criminal Division's International Forfeiture Support Services Contract which is unique to the Criminal Division. DOJ requires Management Analysis Inc. to provide support services to assist in the areas pre-award phase of the Forfeiture Support Services contract. The contractor shall assist with source selection, implementation, and operations and management support to establish and processes, procedures and controls arising from the award for the issuance of this contract into the Program Operations Unit's accountabilities. The statutory authority permitting other than full and open competition for this contract extension is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, which provides for limiting competition in those situations where only one responsible source and no other supplies or services will satisfy agency requirements. No source other than the incumbent can satisfy this need given the transition period that would be required and conducting a follow-on acquisition for this need would result in unacceptable delays in fulfilling the agency's requirements. For the reasons noted above, Criminal Division intends to award a purchase order to Management Analysis Inc. to ensure that the Criminal Division is able to meet its mission and to continue services while it completes the follow-on solution. THIS NOTICE IS NOT A REQUEST FOR COMPETTIVE QUOTES and no solicitation will issued, however any firm that believe it can satisfy the requirements must give written notification to the Contracting Officer in the form of a capability statement. All supporting evidence must be in sufficient detail that demonstrates the ability to comply with the requirements and must be furnished to the point of contact listed below by Friday July 26, 2013 at 2:00 PM EST. A determine by the government not to compete this proposed purchase order based on responses to notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
