- The U.S. Securities and Exchange Commission (SEC), Washington, DC intends to award a sole source contract to Avox Limited, Redwither Tower, Redwither Business Park, Wrexham, LL 13 9XT, the United Kingdom (UK). This will be a one-time purchase order (PO) for business entity reference data for each counterparty in the Trade Information Warehouse (TIW) database from their inception to the receipt of order. Section 763(m)(2) of Title VII of the Dodd-Frank Act requires the SEC to issue written reports to make available to the public information relating to (i) the trading and clearing of the major security-based swap (SBS) categories; and (ii) the market participants and developments in new products. SEC staff has access to the Depository Trust Clearing Corporation (DTCC) Trade Information Warehouse (TIW), which provides transaction and position data for security-based swaps, and includes counterparty names. In order to analyze the swaps industry, the SEC requires additional information about what kind of entities the market participants are and what their business linkages are. The contract action is for services for which the Government intends to solicit and negotiate with only one sole source under the authority of FAR 6.302-1 and the Title 10 U.S.C. 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Negotiation being conducted using other than full and open competition procedures pursuant to authority of FAR 6.302-1. Responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. This notice of intent is not a request for competitive proposals. The Government will not be responsible for any cost incurred in preparation of statements, proposal, or quotations. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation or additional information will be made available with regard to this sole source notice.
