- On June 13, 2013, the Technology Acquisition Center awarded Task Order VA118-1004-0014 to ByLight, Professional IT Services, Inc., in the amount of $1,539,096.66. This task order was awarded under Transformation Twenty-One Total Technology Contract VA118-11-D-1004. This task order fulfills the Office of Information and Technology (OIT), Product Development's (PD) requirement for development services to analyze, design, build, test, and deploy MyHealtheVet version 12.6, which is scheduled for deployment in September 2013. The period of performance of this task order is 3-months, which was fully funded in the amount of $1,539,096.66 at time of award. The Justification and Approval is below. JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a 3-month firm-fixed price (FFP) Task Order (TO) for MyHealtheVet (MHV) Core Development and Enhancements in support of the MHV Program. This TO is proposed to be awarded against Contract Number VA118-11-D-1004, under the Transformation Twenty-One Total Technology (T4) Contract. 3. Description of the Supplies or Services: The proposed action is to provide development services to analyze, design, build, test, and deploy MHV version 12.6. MHV is a Veteran facing web portal that serves over 2.2 million users. Veterans are provided a complex set of features to allow them to participate in the management of their health care including secure email services with all VA clinicians and dentists, online prescription refill services, and the ability to download their VA Personal Electronic Health Record (also known as "Blue Button") in three different formats. The Contractor shall develop new applications and application features for MHV projects, to include, Secure Messaging, MHV and eBenefits Portal Integration, Authentication Gateway, and Capabilities Enhancement. The Contractor shall provide technical enhancement to, and support for, existing MHV applications for the interaction between and presentation of related MHV applications, widgets, web parts, and supporting database inquiries and data exchanges that comprise MHV. The total estimated value of the proposed action is ___________. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(C), entitled "The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order." 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is ByLight Professional IT Services, Inc. (ByLight), 3101 Wilson Blvd Suite 850, Arlington, Virginia 22201. Under Contract VA118-11-D-1004, TO VA118-1004-0005, the Contractor provided analysis, design, build, test and deployment for four major MHV releases, and over 100 features and enhancements. ByLight has worked very closely with the business, technical and functional resources in the VA over the past 11-months, and has gained significant knowledge of the design and architecture of the current MHV system. MHV version 12.6 is currently scheduled for deployment in September 2013, and ByLight is the only vendor who can meet this scheduled release date. Competing the development of MHV version 12.6 would require up to 3-months for new personnel to undergo the appropriate background investigation and obtain Personal Identity Verification cards, and 1-month for transfer of knowledge. Additionally, a new vendor would take several months to fully understand the complexities of all of the MHV custom features in order to successfully develop and release MHV version 12.6. Several of the MHV version 12.6 activities are currently in analysis and design by the Business Office, VA and the Bylight team. MHV version 12.6 has been scheduled for over a year. Failure to complete MHV version 12.6 by September 2013 will cause a schedule impact to 15 related project teams, and delay several tools designed to provide direct healthcare support to our nation's Veterans. ByLight is the only vendor who fully understands the complexities, has an approved design, and can meet the coding, testing and approval schedule. Continuing performance with ByLight will substantially reduce the technical and schedule risks associated with switching to a new vendor to analyze, design, build, test, and deploy the MHV version 12.6. 6. Efforts to Obtain Competition: Market research efforts were conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(D), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: There are no barriers to future competition. It is anticipated that future efforts for MHV Core Development and Enhancements will be issued on a competitive basis with a less aggressive deployment schedule. 8. Market Research: In May 2013 the Government's technical experts reviewed sources that provided capabilities for similar work. These sources were identified from a June 14, 2012 task order that was previously awarded. Of the sources previously and recently reviewed, the average time proposed between TO award and the commencement of work for a code release was 39-days. The average time proposed for a release to be completed from start to finish was 68-days. Based on this market research, only ByLight, as the incumbent contractor, possesses the technical expertise and experience specific to the MHV System which is necessary to analyze, design, build, test, and deploy the MHV version 12.6 to meet the deployment schedule of September 2013. 9. Other Facts: The MHV Core Development and Enhancements effort was competitively awarded under the T4 program. In accordance with FAR 16.505(b)(2)(i)(C), this logical follow-on effort shall be awarded on a sole-source basis as all awardees were given a fair opportunity to be considered for the original order.
