Description
Sources Sought: This is a Sources Sought Notice. The Bureau of Reclamation (Reclamation), Acquisition Operation Group, Denver, CO, is requesting information on potential commercial services to provide expert technology transfer consultant services to the Research and Development Office and other Reclamation programs/projects pertaining to utilizing Federal Technology Transfer and related authorities to accomplish Reclamation's R&D objectives through public/private sector research related partnerships. Reclamation's Research and Development Office requires the expertise, special knowledge, and experience of a consultant that has a long history of successfully implementing and managing Federal Technology Transfer and related authorities. In response to the October 2011 Presidential Memorandum: Accelerating Technology Transfer and Commercialization of Federal Research in Support of High-Growth Business, Reclamation ( through the Research and Development Office) will pursue creative ways to streamline technology transfer processes, design new programs, and create new public/private research partnerships toward optimizing technology transfer outcomes and impacts. The expert consultant will need to provide expert insights into existing barriers and develop creative, reliable recommendations on how to overcome barriers and pursue these initiatives, while being solidly supported by existing federal technology transfer and related authorities. The ability to translate such recommendations into draft implementing guidance and processes is vital. Qualifications To be considered as an expert technology transfer consultant, the candidate shall: "Federal Technology Transfer Authorities: oPossess a minimum of 10 years of experience and expertise in implementing federal technology transfer authorities including the Stevenson Wydler Technology Innovation Act of 1980, Federal Technology Transfer Act of 1986, as amended, Executive Order 12591, Patent and Licensing legislation, the Bayh-Dole Act, and other relevant legislation. oDemonstrated extensive knowledge in developing and negotiating technology transfer agreements and finding creative ways to bring federal technologies to the American marketplace. oAssessed and executed technology transfer activities that ensured such activities were conducted in accordance with federal technology transfer authorities. oDemonstrated extensive knowledge in the development and implementation of new programs while assuring compliance with applicable regulations. "Experience in Managing Technology Transfer Programs for Federal Agencies: oPossess a minimum of 10 years of experience in managing technology transfer programs for federal agencies. oBe recognized as the expert in the technology transfer community for executing technology transfer activities that make an impact for Federal government, industry, and the American public. oPossess extensive experience in providing information and advice to management, technology transfer staff, and research groups on operational guidelines setting research planning, and activities related to technology transfer. "Federal and Nonfederal Partnerships: oDemonstrated success in building effective federal and non-federal research technology transfer partnerships. Worked directly with local, state, and Federal agencies, economic development councils, partnership intermediary networks, industry trade associations, industry partners, academic institutions, nonprofit organizations and other organizations to develop and implement innovative approaches to transfer, commercialize, or otherwise utilize federal investments for the benefit of the American public and U.S. industries. oHave extensive practical and successful experience in designing technology transfer partnerships and agreements that deliver mutual benefits while addressing the individual needs of all parties involved. oExtensive experience in working with the private sector under federal technology transfer agreements. oHas a solid understanding of industry perspectives related to research, intellectual property, commercializing new products, developing new businesses, and working with federal agencies and international organizations. "Federal Research Technology Transfer Community: oExperience in working with research teams, technology transfer programs, and technology transfer organizations across multiple federal agencies. oKnowledgeable about technology transfer practices and research strengths in other government agencies. oAbility to harvest best practices and facilitate collaborations across federal agencies and facilitate the exchange of relevant information available within the federal government. "Intersecting Laws and Policies: oDemonstrated thorough understanding and experience in implementing laws and policies that govern protected and public information. (e.g. Federal confidential information, Trade Secrets Act, Freedom of Information Act). oDemonstrated skills in understanding and managing how other federal laws and policies (e.g., Federal Acquisitions Regulations, Financial Assistance Regulations, and ethics issues) can intersect and impact federal technology transfer activities. "Analytical and Communication Skills: oAbility to synthesize complex information and scenarios, assess situations and plan effective course of action to meet technology transfer stakeholder objectives. oAbility to assess complex information to develop practical recommendations that are in accordance with technology transfer laws and policies. oDemonstrated skills in developing, planning, managing, executing, documenting and communicating all technology transfer activities to decision makers and provide recommendations on the appropriate course of action to ensure multiple agency needs are met while advancing the nation's economic competitiveness. THIS IS NOT A SOLICITATION. ALL COST ASSOCIATED WITH PROVIDING INFORMATION AS REQUESTED BY THIS SOURCES SOUGHT NOTICE SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR. Submission is voluntary. Anticipated award date is 8/1/2013. NAICS code 541712 with a Small Business Size Standard of 500 employees. Responses to this announcement are requested from (1) SBA certified Small Business HubZone firms; (2) Small Business firms certified by a Small Business Administration (SBA) district or regional office for participation in the 8(a) program; (3) Service-Disabled Veteran-Owned small Business firms; (4) Small Businesses (5) Large Business. In response to this announcement, please indicate your firm's socioeconomic status (e.g. small business, service-disabled veteran-owned, women owned, HUBZone, etc.) This information will assist the Government in determining how small businesses can fit into the acquisition strategy. Any information submitted is voluntary. If sufficient interest and capability is not received from firms in categories (1) through (4) above, any solicitation may be issued as unrestricted without further consideration. Interested firms shall submit: (1) NAME, ADDRESS, and PHONE NUMBER OF THE FIRM (including DUNS NUMBER); (2) a CAPABILITY STATEMENT including (a) RECENT (within the last three fiscal years) RELEVANT (similar projects to this requirement) performance history (identify the name of the owner and their point(s) of contact with telephone and fax numbers, e-mail addresses; and (b) in what capacity (e.g., prime, subcontractor etc.) they performed the work; and (3) their SIZE STATUS. Your company must have a DUNS number and be registered on-line at the System for Award Management (SAM). You will also be required to provide your small business status information either via the RFP or the On-line Representations and Certifications (ORCA) also located at the SAM website before an award to your company can be made. Your on-line ORCA registration will cover any/all of your offers to the Federal Government, and only needs updated annually. This request is to gather information from interested parties and is deemed essential as part of our collaborative, deliberate planning process for future acquisition planning if the information submitted indicates a strong commercial capability exists for Reclamation's intended applications or for research and development efforts with qualified industry representative(s) to develop and commercialize the capacity sought. This is NOT a Request for Proposal (RFP) or Invitation for Bid (IFB) and does not constitute any commitment by the Government. Responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. No entitlement to payment of direct or indirect costs or charges by the Government will arise as a result of the submission of contractor's information. The Government shall not be liable for or suffer any consequential damages for propriety information not properly identified. Propriety information will be safeguarded in accordance with the applicable Government regulations. Response to this sources sought will not be returned. Responses to this sources sought notice will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitation announcements separately from responses to this market survey. Any solicitation that may be issued will be posted on the Federal Business Opportunities website and no paper copies will be provided.
