- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Under Simplified Acquisition Procedures (SAP) Simplified Acquisition Threshold ($3K to $150K) For Restricting Competition under FAR 13.106-1(b)(1) "Single Source" 1.Contracting Activity: Department of Veterans Affairs, VISN 20, Puget Sound Health Care System Seattle VA Medical Center Logistics service requests a Justification for Other than Full and Open Competition to be purchased by Network Contracting Office 20, 5115 NE 82nd Ave Suite 103 Vancouver, WA. 2.Nature of the Action Being Processed: The proposed contract is for a 9mm Reusable Probe (Neoprobe) with Bluetooth ® Wireless Technology and 14mm External Collimator from Mammotome. This will be a firm-fixed price purchase order. 3.Description of Supplies or Services Required to Meet the Agency's Needs: The Reusable Probe and External Collimator is a backup for an item already in use at the Seattle VA and must be an exact match in order to ensure equipment compatibility, prevent sterilization mishaps and patient safety errors. An additional probe is needed due to the lengthy sterilization process and the surgery demands. The estimated cost for the items is 32,054.20. Funding is committed on VA 2237: 663-13-2-9961-0049. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions under $150,000 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 253(c), as implemented by FAR 13.106-1(b)(1). The contracting officer has determined that the circumstances of the contract action deem only source reasonably available. Only one brand will meet the government's needs, and this is the only distributor of this brand. This justification is where in accordance with FAR 6.001(a), acquisitions conducted under FAR 13 for SAP are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2, IAW the VHA SOP for Other Than Full And Open Competition dated 3-22-2011. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only the brand name requested will meet the Seattle VA's needs due to sterilization procedures, patient safety, and equipment compatibility. Every piece of equipment has a unique sterilization process. In order to streamline the sterilization procedures, as well as to prevent equipment damage, the same model of probe must be purchased. Standardization is also an important factor for patient safety and efficiency - staff need only learn the protocol for one item instead of two that perform the same function, saving training dollars, decreasing the risk of confusing the two probes. Additionally, the accessories for this item (the external collimeter) will work with both probes if the same brand is purchased. According to Mammotome's website, they do not have any authorized distributors for their products. We cannot purchase this brand name item from anyone other than Mammotome. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: A web search was done to attempt to locate any other authorized retailers of this product, as well as a search on Mammotome's website for authorized distributors. None were found. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: When the Seattle VA purchased the first Probe, Mammotome was the only one on the market that had BlueTooth ® technology. Since then, several other manufacturers have added this feature, but none are an exact match to the item already in use in the hospital. These other items can, however, be used for price comparison in accordance with FAR 13.106-3(a)(2)(ii) comparison of the proposed price with prices found reasonable on previous purchases. The proposed price is determined fair and reasonable when compared to the previous purchase price of $32,325.28 in October 2010 (Purchase Order 663-A10021). 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): Market research was conducted in accordance with FAR part 10, but only one vendor was found to provide this brand name product. 9.Any Other Facts Supporting the Restriction of Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making Subsequent Acquisitions for the Supplies or Services Required: If additional quantities are contemplated, or when the original probe is nearing the end of its life, the Seattle VA may consider switching both probes to a different brand if it is more cost-effective to do so. 12.
