Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 02, Human Resources, Syracuse Medical Center. It is the intent of VISN 2 Human Resources for the Syracuse Medical Center, 800 Irving Avenue, Syracuse, NY to sole source this requirement to The Graduate School USA (Vendor #4576). 2237 transaction number is 528-13-3-7709-0020. 2.Nature and/or Description of the Action Being Processed: This is a request for conference registration and fees, for three TCF HR Interns to attend the "Federal Labor Relations" conference in Washington, DC. Dates of the conference are June 18, 2013 through June 21, 2013. This is a firm, fixed price procurement. The registration fee for each of the TCF Interns to attend this conference is $1,295.00 each, for a total of $3,885.00. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Services requested are to register three TCF HR Interns for this conference. Each registration fee is $1,295.00 (x three = $3,885.00). Registration is through vendor known as The Graduate School USA (Vendor #4576). The TCF HR Interns who will be attending the conference will be David Janczyk, Evon Francis, and Kathryn Impelizzieri, all VA TCF HR Intern employees. This is a fully-funded training authorized by Mark Antinelli, HR Manager to meet the TCF Intern program requirements, and funded under FCP 7709. This conference is a four-day conference, June 18-21, 2013. Graduate School USA - http://www.graduateschool.edu/course_details.php?cid=STAF7009D 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only One Responsible Source (FAR 6.302-1) - The Graduate School USA is the only vendor offering the "Federal Labor Relations" Conference for four (4) days within our required timeframe. The information and knowledge the TCF HR Interns will gain by attending this particular conference is invaluable as a result of the time available to cover more in-depth material relative to "Federal Labor Relations." Given the complicated nature of Federal Labor Relations and its interaction not only with established policies and procedures, but also legal rules and regulations, it is imperative that all courses on the subject be capable of sustaining the breadth of knowledge required for such a topic. From reviewing the other programs at comparable institutes, it is our understanding that the Graduate School USA is the only one who tries to bridge the gap between Policy, Practice, and Law. They cover not only the areas of negotiations and process, as most other programs do, but also devote a significant portion to Labor Relations Laws, legal wording, and their effect on the Labor Relations process. Poorly trained practitioners of Labor Relations open the VA up to severe legal ramifications. It is mandatory that any program selected to train employees in this area have a scope broad enough to cover such diverse areas of Labor Relations Law, as well as the general tools and negotiation techniques that are common to every course of this nature. This, coupled with the fact that The Graduate School USA offers the longest course available from any of its competitors, reflects that they are prepared to take the time to dig deep and ensure that all attendees are properly trained in such diverse broad-reaching subjects. These facts make The Graduate School USA the obvious choice among competitors. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Current market analysis shows The Graduate School USA to be the best conference for the TCF HR Interns to attend due to length of the conference and the price. Other available vendors are more costly to the Government and/or shorter in duration. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price has been determined fair and reasonable in comparison to past costs to the government procured via 2237 number 528-13-1-7709-0007 at $1,395.00 per person. The Graduate School USA cost for this conference is $1,295.00 per person or $323.75 per day. The lowest cost other available vendors would charge is $300.00 per day for a two-day conference. The total cost of $1,295.00 charged by The Graduate School USA is the same price offered to the public. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research has been conducted. The price offered by The Graduate School USA is competitive with industry standards. Other available vendors were researched and found to be more costly for these services and shorter in duration. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Other vendors researched by HR staff and the Education Department were the following: Human Resources Institute (2-day, $395.00 per person), Federal Labor Relations Authority (2-day, $300.00 per person), and the Federal Management Institute (1-day, $395.00 per person). The Graduate School USA offers the best inclusive program for the price. 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No action is planned at this time.
