- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a four month firm-fixed price (FFP) contract for a Patient Monitoring Network Upgrade to the VA White River Junction (WRJ) VA Medical Center (VAMC) patient monitoring network. The proposed source for this action is Philips Electronics North America Corporation DBA Philips Healthcare, 3000 Minuteman Road, MS0400, Andover, MA 01810-1099. 3. Description of the Supplies or Services: The purpose of the proposed acquisition is to upgrade the VA White River Junction VA Medical Center patient monitoring network located in White River Junction, VT. Equipment will include items such as hardware upgrades to the patient monitoring central stations, roll stands, bedside mounting and connector kits, pressure interconnect cables and blood pressure cuffs. The contractor shall also be responsible for providing installation, implementation, software upgrades, and product upgrade services. 4. Authority: The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Rationale Supporting Use of Authority Cited Above: The proposed source is Philips Electronics North America Corporation DBA Philips Healthcare, 3000 Minuteman Road, MS0400, Andover, MA 01810-1099. The current WRJ VAMC patient monitoring network, utilizing Philips Healthcare equipment, was implemented in fiscal year (FY) 2003, when the determination was made to replace the existing General Electric based system because it had reached the end of its life and required replacement. After evaluation of current patient monitoring solutions available in the marketplace, it was determined that Philips Healthcare equipment met all of WRJ's needs and was the most cost effective solution available. Further market research was conducted in Fiscal Year (FY) 2012, details of which are in the market research section of this document, to determine if other solutions currently exist in the market that can satisfy the government's requirements. It was determined that it was not in the best interest of the Government to replace the current system with equipment other than Philips Healthcare. Philips Healthcare is the only company that can provide the necessary hardware, software and service support to upgrade WRJ's patient monitoring network as the required hardware and software upgrades are proprietary to the company. In addition, because this is an upgrade to an existing system no other brand name or equivalent equipment will be compatible with the system resulting in loss of functionality. Therefore, introducing new equipment would require a complete replacement of the Philips Healthcare based system resulting in a negative impact to patient care due to downtime and disruption to the patient monitoring network, additional cost and time to train VA personnel on the new equipment. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Actions to Increase Competition: The Government will continue to review and ascertain potential solutions available in the marketplace to determine if and when it is in the best interest of the Government to replace the existing patient monitoring system to include such a time when the current system has reached the end of its lifecycle and more robust patient monitoring systems are available to meet the Government's requirements. 8. Market Research: Market research was conducted in FY 2012 to determine if other solutions exist in the market that can satisfy the government's requirements. It was determined that it was not in the best interest of the Government to replace the current system with equipment other than Philips Healthcare. The Market research consisted of evaluating the current status of all Philips monitoring equipment in Veterans Integrated Service Network (VISN) 1 with respect to age and condition. The rationale was that the West Haven facility will be replacing their General Electric monitoring system (end of life) this fiscal year (2013). If the current status of the Philips systems in the rest of the VISN (Philips has been the VISN standard equipment for eight years) was poor enough for replacement consideration, the VISN would take the opportunity to do a new evaluation of standard equipment. It was found that the current status of the existing Philips monitoring systems in VISN 1 does not justify replacement at this time. Additional market research was performed by the Technology Acquisition Center (TAC) in February 2013, to identify potential resellers of Philips Healthcare products. Market research was conducted utilizing the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) Government Wide Acquisition Contract (GWAC) Manufacturer Lookup tool. Philips Healthcare is not a vendor on SEWP and the required products are not available from any vendors on SEWP. A Request for Information (RFI) was posted on the Federal Business Opportunities (FBO) website to seek potential sources for the Patient Monitoring Network Upgrade on February 28, 2013. On March 01, 2013, Philips Healthcare was the sole respondent capable of providing the Philips Monitoring upgrade to the existing system. Furthermore, it was discovered that Philips Healthcare requires that only certified Phillips parts be used that meet their manufacturer's specifications and that Philips Healthcare holds the proprietary license and related authorizations for Philips Monitoring products, supplies and support. While other sources can provide similar patient monitoring solutions, this would require the replacement of the entire Patient Monitoring System currently in use at WRJ VAMC. Only Philips Healthcare possesses the required proprietary hardware and software to satisfy the Patient Monitoring Network upgrade to ensure operations are met without disruption. 9.
