Description
Modification SF-30 Award Document Solicitation J&A Document Washington Headquarters Services (WHS) Acquisition Directorate (AD), on behalf of WHS Enterprise Information Technology Services Directorate (EITSD), had a requirement to renew Windows Server and Windows SQL Server licenses, for the Office of the Under Secretary of Defense for Acquisition, Technology, and Logistics (OUSD(AT&L)) ITM. Market research indicated these items were SIN 132-33: Perpetual Software License; and NAICS 541519: Other Computer Related Services. Market research indicated that these items were available on DoD Enterprise Software Initiative. Pursuant to Department of Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance and Information (PGI) 208.7403, "If the software or services are available, the requiring official shall fulfill the requirement from the DoD inventory." The estimated cost was over the simplified acquisition threshold (SAT), defined in FAR 2.101 as $150,000, except for acquisitions of supplies or services that, as determined by the head of the agency, are to be used to support a contingency operation or to facilitate defense against or recovery from nuclear, biological, chemical, or radiological attack. However, the requested items were commercially available from Microsoft. Therefore, this acquisition was eligible for the commercial item test program defined in FAR Subpart 13.5. The FAR Subpart 13.5 test program provides for the use of simplified procedures for the acquisition of supplies and services in amounts greater than the SAT but not exceeding $6.5 million, including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial items.
