- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This requirement will be satisfied using commercial acquisition procedures specified in FAR Part 12, in conjunction with FAR Part 13. Solicitation number HSCG38-13-Q-300045 is assigned to this procurement for tracking purposes only and is issued as a Request for Quotation (RFQ). The incorporated clauses and provisions are those in effect through Federal Acquisition Circular 2005-66. This solicitation is unrestrictive. The North American Industry Classification System Code is 336413. The Government intends to issue a Purchase Order to Apache Enterprises Inc. on an other than full and open competition basis for the purchase of various Night Vision Goggle Cockpit Lens Caps for use on the USCG HC-130H Aircraft. Apache Enterprises Inc. is the OEM and products produced by another manufacturer are not acceptable because a substitute product will require a re-certification of the aircraft’s flight deck. All responsible sources may submit a quotation which will be considered by the agency. Only newly manufactured material is acceptable and sources other than the OEM must be able to provide traceability of all items to the OEM. Partial deliveries and earlier deliveries are acceptable at no additional cost to the Government. The actual delivery date will be established upon issuance of the resulting Purchase Order. Quotes shall also include Offeror’s Cage Code and any payment discounts, which will be used for the payment of invoices. Payment discounts are not evaluated as part of the price evaluation. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE. Purchase of various Night Vision Goggle (NVG) Cockpit Lenses used on the HC-130H aircraft. Required for NVG compatible missions. 5. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. Night Vision Goggles are used to perform specific missions at night when aircraft lighting can be detrimental to the overall mission, or when looking for specific heat signatures. Such as a person in a lift raft or a group of people in the water. NVGs require special filtered lighting in order to work properly. These filters or “lenses” are used in various components and/or systems on the flight deck. These lenses are manufactured to specific military standards that were set forth in the original statement of work. No other cockpit lenses will satisfy this requirement. Any substitution for these parts will require a recertification of the flight decks NVG capabilities. Currently Apache Enterprises, Inc. is the only authorized company with the engineering data capable of manufacturing these components. 6. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES A Night Vision Goggle (NVG) Cockpit upgrade was installed on the HC-130H aircraft as part of a Coast Guard mandated safety program. This requirement led to a full and open competition announcement. As a result of the solicitation, Apache Enterprises, Inc. was awarded the Cockpit Lenses required for this buy. Any attempt to substitute the cockpit lenses now would potentially set the program back and jeopardize the installation schedule. Due to cockpit standardization; all previous aircraft would need to be modified to accept any changes resulting in a substitution. It would not be in the best interest of the Government to pursue such a change. Apache Enterprises, Inc. is the only company with the engineering data capable of manufacturing this component. Apache Enterprises, Inc. is the OEM. Apache Enterprises, Inc. has not sold the manufacturing data to any other vendor. Apache Enterprises has the equipment, tooling, and drawings necessary to manufacture the cockpit lenses. 7. EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. At the time of the original acquisition, the Coast Guard did not purchase the technical data and drawings necessary to support this product. Apache Enterprises, Inc. is the OEM for this material and market research did not find any additional sources capable of manufacturing this material as of April 16, 2013. 8. PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. IF THIS IS A FOLLOW-ON ACTION TO A PREVIOUSLY COMPETED ACTION, SO STATE. The USCG does not have the required data, manuals, or drawings to overcome the sole source barrier to competition. The various cockpit lenses are manufactured solely by Apache Enterprises, Inc. The Coast Guard will maintain open communication with Apache Enterprises, Inc. and will continue market research to identify possible sources capable of manufacturing this material. 9A.
