Description
Schedule & Clause Far 52.212-5 (1) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR) as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The awarded contract will be firm fixed price. (2) This solicitation is issued as a Request for Quotation (RFQ). (3) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66B (4) The solicitation is being issued as a Total Small Business Set-Aside. The associated NAICS code is 332322 Sheet Metal Work Manufacturing. The Small business size standard is 500 employees. (5) Far Clause 52.212-4 Contract Terms and Conditions Commercial Item is incorporated. The FAR clauses and provisions can be accessed via Internet at www.acquisition.gov/far (6) The Combined synopsis/solicitation is for the purchase of the following commercial items. General Information: The intent of this solicitation is to obtain quotes for Culvert and Bands, corrugated galvanized steel, helical with annular ends for bands. All culvert/bands will be 16 gauge. The culvert will be 18, 24, & 36 inches in various lengths from 10-16 feet of various quantities. SCHEDULE OF ITEMS See attachment CONTRACT TIME Delivery date is 90 days after award of the contract. DELIVERY LOCATION Delivery location is the Hungry Horse Ranger Station-Warehouse 10 Hungry Horse Drive Hungry Horse MT 59919 Advance notification of delivery is required so equipment can be provided to off load the items upon delivery. BASIS OF AWARD Offer of award will be made to the quoter whose quote, as determined by the Contracting Officer, provides the best value to the Government, considering but not limited to such factors as price, and past performance. GENERAL SPECIFICATIONS SCOPE OF CONTRACT Contractor shall furnish materials, supplies, transportation and supervision necessary to provide culverts and bands for the Flathead National Forest. PAYMENT Payment will be made upon completion and acceptance of items and receipt of the Contractor's proper invoice. CONTRACT CLAUSES AGAR 452.209-71 Assurance Regarding Felony Conviction or Tax Delinquent Status for Corporate Applicants (FEB 2012) Alternate I (FEB 2012) (a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it - (1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and (2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government. (b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434. FAR 52.236-7 Permits and Responsibilities (NOV 1991) The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract. (2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timelines, provided the offeror complies with the time and format requirements for resubmission prescribed by the Contracting Officer. (e) The Government reserves the right to make award solely on the facsimile proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete original signed proposal.
