DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 4, Louis A. Johnson VA Medical Center COST: $34,200 BARD PERIPHERAL VASCULAR, 1451 W 3rd Street, Tempe, AZ 85281. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of Bard Peripheral Vascular Flair, endovascular stent graft. 3. Description of Supplies/Services Required to Meet the Agency's Needs: Items needed include the product codes, par levels and cost per items listed below, for an overall acquisition of $34,200. Par level and product code Bulk order price 3 ea. FAS07040 - 7x40. $ 1,900 3 ea. FAS07070 - 7x70. $ 1,900 3 ea. FAS09040 - 9x40. $ 1,900 3 ea. FAF07050 - 7x50. $ 1,900 3 ea. FAF08050 - 8x50. $ 1,900 3 ea. FAF09050 - 9x50. $ 1,900 4.Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): U.S.C. 253(c)(5) and 38 U.S.C. 8123 as illustrated in VAAR 806.302-5(b)(1) authorize the procurement of orthopedic and prosthetic appliances without providing full and open competition. The Flair stents to be purchased are highly-specialized, brand name items that have been preferred and frequently used by the vascular surgeon at this facility. The appropriate implantable devices required by Veterans are determined by a physician on a case-by-case basis and are deemed a medical necessity. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Flair Stent is the only FDA approved stent for AV access site. FDA approval letter is attached. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The prices for these stents are comparable to similar-sized stents that have been purchased recently by this facility from other manufacturers. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: FAR Part 10 directs market research be conducted for each acquisition appropriate to the circumstances. The request had a short delivery period due to patient needs. A review of the FBO Synopsis/Solicitation (VA261-12-Q-0828) for VISN 21 Reno, Nevada established that they paid $2,943.89 per stent. Market research was conducted and entered into eCMS briefcase labeled P02 Market Research. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Nothing that has not been addressed thus far. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None
