March 15, 2013 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Actjvitv:Acquisition Service-Frederick Department of Veterans Affairs 8490 Progress Drive Frederick, MD 21701 On Behalf of Agency: VA Medical Center- Boston 55 Fruit Street Boston, MA 02114 2. Description of Action: The Department of Veterans Affairs Medical Center Boston proposes to negotiate a noncompetitive award (sole source) with Compumedics USA for the procurement of two (2) licenses to provide Curry 7 Basic and Advanced Source Analysis software and training for this software. The total estimated value of this requirement is $30,000. 3. Description of Supplies or Services:The purpose of this requirement is to purchase a software analysis package for advanced analysis of EEG data geared towards epilepsy surgery. Approximately 1/3 of all patients with epilepsy continue to have seizures despite aggressive medical treatment. In such cases, surgery to remove the portion of brain that initiates seizures may be curative. The treatment option is currently not available within the VA, but Is a medium range goal of the Boston Epilepsy Service given the number of veterans currently treated for intractable seizures. As part of the workup for epilepsy surgery, se.izures must be well characterized in terms of the areas of brain involved. The Curry 7 package is an advanced software package that allows integration of MRI, EEG, and PET scan data to characterize seizures. 4. Identification of Statutory Authoritv: FAR Part 6.302-l(c) "Only one responsible source and no other supplies or services will satisfy agency requirements." 5. Demonstration of Contractor's Unique Qualifications:Compumedics Neuroscan is the sole manufacturer and only distributor of the Curry software (proprietary). Curry has been specifically designed to provide a customizable tool for all types of source localization research. With its ability to import EEG, MEG, CT, MRI, fMRI,PET and SPECT data,Curry is the most advance tool for source localization available. Curry also uses patent pending technology for dipole confidence interval estimation and provides unsurpassed flexibility in localization options. To the best of Compumedics Neuroscan's, knowledge there is no other system that provides these extensive capabilities. March 15, 2013 The advanced software Curry 7 provides allows integration of MRI, EEG, and PET scan data to characterize seizures. Although there are other software programs that provide each of these systems, no other providers could be located that have software that integrates all three,MRI,EEG, and PET scan data into one software. 6. Description of Efforts to Obtain Competition: Due to the exclusive requirement for Curry 7 software and this software being proprietary to and available only from Compumedics USA Inc., competition is not available. Curry 7 is only available through Compumedics Neuroscan Inc. All future requirements will be handled on a case-by-case basis to facilitate a competitive environment. 7. Determination of Fair and Reasonable Prices:The Contracting Officer will determine that prices to the Government are fair and reasonable. 8. Market Survey: Market Research concluded that the Compumedics Neuroscan Curry 7 Program License is proprietary and sold only via Compumedics USA Inc. Because more than one program would need to be incorporated into the system in order to achieve the results of the Curry 7 software,resulting in a higher overall cost and time involved to utilize separate programs, it is in the best interest of the Government to procure the Compumedics Neuroscan Curry 7 Basic & Advanced Source Analysis program and training. The costs associated with the purchase of another software solution as well as training would not be a cost effective benefit to the Government. The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions In support of similar requirements. All future requirements will be handled on a case-by-case basis to determine alternative procurement strategies. 9. Other Facts Supporting the Use of Other than Full and Open Competition: None 10.
