- SECHQ113R0008 PRICING SECHQ113R0008 PWS This is a combined synopsis/solicitation for commercial items prepared for the purchase of a variety of filing fee consulting and administrative services in support of the SEC Office of Financial Management, Filing Fee Branch, in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice and the attached Performance Work Statement (Attachment 1). This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is SECHQ113R0008 and is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-66. The NAICS code associated with this procurement is 541611 Administrative Management and General Management Consulting Services with a size standard of $14,000,000.00. This is a small business set-aside. Respondents shall follow the contract line item number (CLIN) structure detailed in the attached pricing schedule (Attachment 2), specifically providing onsite and offsite pricing for each labor hour category. The Period of Performance is for one base year and four option years. The anticipated award date is June 15, 2013. The place of performance is 100 F. Street NE, Washington, DC 20549. The following FAR provisions apply to this acquisition: 52.212-1 Instructions to Offerors (Feb 2012). The following submission instructions also apply: Each Offeror is requested to submit one electronic and 4 hard copies of your firm's offer. LATE OFFERS MAY NOT BE ACCEPTED. Questions regarding this Request for Proposal must be submitted in writing and sent via email to the attention of Takela Morris at morrist@sec.gov and carbon copy (cc) Regina Mumford-Rush at Mumford-RushR@sec.gov no than 1:00 PM Eastern Standard Time, on May 9, 2013. Questions received after that date/time may not be addressed. All offers must include the following information (preferably to be provided on the offer cover letter (not included in the page limitation): a) Dun & Bradstreet Number (DUNS) b) Contact Name c) Contact Email address d) Contact telephone and fax number e) Complete business mailing address The Offeror's technical proposal (Volume 1) must demonstrate the firm's capability to perform the requirements outlined in the Performance Work Statement. Offerors shall provide a technical offer that includes the following three (3) general areas/factors: Factor 1, Technical Approach and Understanding; Factor 2, Management Approach and Capabilities; and Factor 3, Past Performance. Technical Approach and Understanding: The Offeror must identify and describe their technical approach that satisfies the requirements defined in the Statement of Work. The Offeror's technical approach shall include the following: 1) discussion of the background, objectives, and work requirements of the PWS; 2) discussion of proposed methods and techniques for completing each task; 3) discussion which supports how each task will be evaluated for full performance and acceptability of work from the Offeror's perspective; and 4) discussion of any anticipated major difficulties and problem areas, along with potential recommended approaches for their resolution. Management Approach and Capabilities: The Offeror's management approach shall include a Project Management Plan that is simple, easy to read and clearly describes project personnel and responsibilities, any proposed subcontracting arrangements, communication and coordination plans, schedules of all tasks and subtasks, meetings, and deliverables. The Offeror's management approach shall include all key personnel as well as labor categories indicated within the performance work statement and a description of the firm's current personnel resources. The personnel portion of your offer shall include: A. Resumes with a description of the experience and capability for the personnel proposed for your project. Descriptions shall address such items as the individual's background, education, work experience and accomplishments. Show the knowledge that the personnel have gained through completed and ongoing efforts that are similar in nature to this effort. Each resume should be limited to two (2) pages. B. Letter of Commitment for proposed new hire in key personnel. C. A staffing plan with a description of the Offeror's current personnel resources for this activity, which addresses the Offeror's capabilities and experience relating to the SOW. Past Performance: Offerors shall provide a list of no more than three current or past contracts (both Government and Commercial) performed within the past five years for whom the Offeror has provided the same or similar services. The contractor shall submit the following information for each contract: 1. Name of agency 2. Contract number 3. Contract type 4. Total contract value 5. Description of the contract work, specifically addressing the relevance of the work, including examples of taglines, description of strategies, etc. 6. Contracting Officer's or similar representative's telephone number and e-mail address 7. List of all disputes associated with the contract 8. List of options that were not exercised and reason(s) why they were not exercised. 10. Problems encountered and how they were resolved In accordance with FAR 15.305, in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated either favorably or unfavorably in this area, but instead will receive a neutral rating in the area of past performance. Offers must demonstrate that both your firm and personnel can successfully complete this project. Page Limitation: The technical proposal shall be limited to ten (10) one-sided pages excluding the cover page, table of contents, resumes (2 pages each), and letters of commitment for proposed key personnel. Offerors shall not include any price information in the technical proposal. VOLUME 2 - PRICE PROPOSAL: The Call will consist of labor categories which will be billed as fixed hourly rates. For the purposes of the evaluation, the Government estimates the level of effort required for fulfilling the contract as indicated in the attached Pricing Schedule. Each Offeror shall submit a price proposal separate from the technical proposal. The price proposal shall include the following: a) Completed Tables 1 and 2 in an Excel Spreadsheet. b) Fixed hourly rates shall be fully burdened and include all costs (direct and indirect), overhead, and profit. c) If applicable, Prime Contractor/Subcontractor Arrangement. If subcontracting is proposed, the Government will evaluate the acceptability of any subcontracting as part of its evaluation of price. d) Offerors shall use their independent judgment in determining their proposed labor categories and labor mix. e) The proposed estimated hours will be utilized by the Government for evaluation purposes and may be utilized as a quote for the first task order. f) Offerors must also submit price proposals in the format of the attached pricing schedule. All proposals must be for all contract line items, as stated. Partial proposals will not be considered. 52.212-2 Evaluation of Commercial Items (Jan 1999) applies. The Government will award an indefinite delivery, indefinite quantity contract with labor hour, time and material, and firm fixed priced task orders resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation, will be most advantageous to the Government, considering non-price factors and price. A multiple award is expected. Award will be made on a best value basis. Technical Approach, Management Approach, and Past Performance are in descending order of importance and are more important than price. Technical proposals submitted in response to this RFP will be evaluated as follows: 1) Technical Approach and Understanding - the degree to which the Offeror effectively demonstrates a knowledge, understanding, and technical ability to successfully perform the requirements of the PWS. Additionally, the appropriateness, soundness and reasonableness of the Offeror's problem resolution approach will be assessed. 2) Management Approach and Capabilities - the demonstrated effectiveness of the Offerors general management approach to providing personnel and all requirements of the PWS; and the adequacy and appropriateness of the proposed Project Management Plan. 3) Past Performance: The SEC will evaluate the Offeror's ability to conform to contract requirements, adhere to contract schedules, and commitment to customer satisfaction for contracts that are similar in size and scope to the Government's requirement. Price Proposal: The Government expects to receive price competition through the submission of several price proposals. The Offeror's proposed pricing will be evaluated against the Government's estimated level of effort. Offeror's shall propose fixed labor rate prices that are both realistic and reasonable. Options will also be evaluated accordingly. Offerors must submit a completed copy of the provision at FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items (Dec 2012) with its offer unless the offeror has Representations and Certifications entered into the ORCA database at https://www.acquisition.gov/far/. Offerors that fail to furnish the required representation information, or reject the terms and conditions of the combined synopsis/solicitation, may be excluded from consideration. When the Government requires supplies or services covered by this contract in an amount of less than $1,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of $20,000,000.00; (2) Any order for a combination of items in excess of $20,000,000; or (3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-22 Indefinite Quantity (Oct 1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after three years of award of contract. (End of clause) As referred to in paragraph (b) of FAR Clause 52.216-22, "Indefinite Quantity" of this contract, the contract minimum quantity is established at $1,000.00. The contract maximum quantity is hereby established at the total amount of $20,000,000.00.
