Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 8, VACHS Medical Center, Acquisition & Material Management, Cardiology Department located in San Juan, Puerto Rico. This is a Justification for Other Than Full and Open Competition. The Purchase Request number assigned to this procurement is 672-13-2-047-2129. 2.Nature and/or Description of the Action Being Processed: This is a request for Only one Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements of Biosense Webster a Johnson & Johnson company for the purchase of a Green Back Pack Cable for the CARTO 3 Electrophysiology Mapping Unit located at the Cardiac Catheterization Laboratory located at VACHS. This is a request for a Firm-Fixed-Price purchase. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The delivery date established five (5) days upon receipt of the purchase order. The Anticipated price to the Government is based on a quotation amount of $5,504.80 for the equipment purchase. This Green Back Patch Cable connects and establishes the vital connection by specifically designed to link data acquisition patch that is placed on the patient's chest and the CARTO 3 unit. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): "This is an Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements need to purchase a Green Back Pack Cable urgently needed for our CARTO 3 Electrophysiology Mapping Unit for the Cardiology Laboratory an essential part to make the CARTO 3 unit operational. "Biosense Webster a Johnson & Johnson Company is the manufacturer for the CARTO 3 Electrophysiology Mapping Unit and its parts. "This part is required for the CARTO 3 Unit, owned by the VACHS, in order for the Unit to be fully operational since this is a cable that connects two essential components of the system: a patch on the patient's chest and the CARTO 3 Operating console. "Not been able to bring the CARTO 3 up to the operational status will and can jeopardize our direct patient care for our Veterans in need of this of Service. "There is no other compatible Green Back Pack Cable for this unit other that the manufactured by Johnson & Johnson. "This Unit is an essential part for the Cardiology Laboratory that will allow the Electrophysiology physician operator to obtain a detailed electro-anatomical map of the heart that allows to more effectively locate, map and treat many diseases of the heart rhythm. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An internet researched and a Sources Sought were conducted and no other company that could provide this cable was found. Biosense Webster is the manufacturer for the CARTO 3 System and procuring other brands does not apply as the Green Back Pack Cable which is a manufacturer - specific part. A sources sought number VA248-13-I-0974 was issued on March 06, 2013. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government is $5,504.80 for the Green Back Pack Cable. Biosense Webster a Johnson & Johnson company is the only responsible source capable since they are the manufacturer and this price is considered fair and reasonable based on current market price and in comparison to an independent Government estimate as per FAR13.106-3(a)(2) 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Biosense Webster is a Johnson & Johnson Company and is the Only One Responsible source capable to provide the Green Back Pack Cable required for the CARTO 3 System. An internet researched and a Sources Sought were conducted and no other company that could provide this cable was found. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This cable is for direct patient care. Not been able to bring the CARTO 3 up to the operational status will and can jeopardize the direct patient care provided. Failure to obtain in a timely manner this part will result in a threat to our Veterans health. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: State "See Section VI above." 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No actions are planned, since this is a purchase for the Green Back Pack Cable for our CARTO 3 unit which is a part needed for the proper function and operation of this unit and which is manufactured by Biosense Webster a Johnson & Johnson company. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
