Description

The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 6.302-1 with Thermo Fisher Scientific in San Diego, CA for the purchase of direct drop-in replacement parts for a wide range and log and linear safety channel drawer assemblies. Thermo Fisher Scientific is the sole source supplier of this equipment because the specifications for this equipment are proprietary to Thermo Fisher Scientific. In addition, Thermo Fisher Scientific owns the Copyright (2004) and PATENT (No. 4495144 & 4568514) for the required spare parts. The parts required are repair items for existing equipment as well as spares meant to be compatible with the current NBSR (National Bureau of Standards Reactor) user interface. The NBSR user interface functionality is specified in our license agreement with the Nuclear Regulatory Commission (NRC). Changing equipment specified in the license would require an extensive review by the NRC. Delivery shall be FOB Destination, Gaithersburg, MD, and is required within 12 months after receipt of order. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received no later than the response date for this notice of intent. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
