- DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Department of Veterans Affairs, VISN 8, West Palm Beach Medical Center, 7305 N Military Trail, West Palm Beach Fl. 2.In order for the Medical Center to comply with the new government-issued energy regulations, changes need to be made to the existing building infrastructure. To accomplish this, a new building automation system is needed since the existing system is obsolete. 3.Contractor will provide all necessary labor, materials, tools, equipment and supervision to remove 54 old control panels and rewire and reprogram existing into newly installed Siemens PXCM panels. 4. In accordance with FAR 6.302-1, this requirement is being procured under the authority of 41 U.S.C. 253(c) (1) - only one responsible source and no other type of property or services will satisfy the needs of the executive agency. 5.Although other contractors may perform a portion of the rewiring work, the reprogramming requires using Siemens proprietary data. 6.On January 22, 2013 the VA issued a Notice of Intent to sole-source this procurement on Fed Biz Ops (FBO). Only one vendor expressed interest by providing his capability statement as was required by the FBO posting. 7.The Contracting Officer performed price analysis on Siemens' proposal and compared the price with that of the Government Estimate and published General Supply Schedule (GSA) Pricing. The Government Estimate was based on past current industry standards. The analysis performed resulted in a determination of Siemens' price as being fair and reasonable for this project. 8.As described in No. 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. 9.The rewiring and reprogramming of the PXCM panels is being procured from Siemens in order to bring the current obsolete system up to date to achieve compliance with new government-issued energy regulations. 10.This is a one-time rewiring and reprogramming of the system and once completed, the system will allow the VA to competitively compete all further building control systems expansions. 11. I certify that the requirement outlined in this Justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. On past acquisitions, General Electric has either matched or offered a lower price than that of the government estimate.
