- This contract action was accomplished using other than competitive procedures because this is a task/delivery order where an exception to fair opportunity requirements was approved due to only one source being available (FAR 8.405-6(b)(1) or 16.505(b)(2)(ii)). Original signed. PAN RS 161-3 NONCOMPETITIVE ACQUISITION SOLICITATION AND APPROVAL I. Procurement Description The Aviation and Missile Research, Development, and Engineering Center (AMRDEC), Weapons Development and Integration Directorate (WDI) requests the purchase of maintenance for MasterKey Plus Base, MSC Nastran MD Implicit NL, MSC Nastran MD Explicit NL Package, and software maintenance renewals through IMMIXTECHNOLOGY, INC. in support of the Platform Integration Function. II. Noncompetitive Justification MSC is the sole developer of the MSC.Patran, MSC.Nastran, MSC SOL400 Implicit Nonlinear, MSC SOL700 Explicit Nonlinear and MSC.Fatigue software, and ImmixTechnology, Inc., McLean, Virginia is MSC's only entity legally capable of providing this service as the only GSA service source. The required software is necessary to allow greater flexibility for conducting spectral analysis, fatigue life estimations, damage estimations, and crack growth rates both analytically and experimentally.As per the requirements of this software and in order to ensure that the software performs to its maximum capability, the maintenance/upgrade is needed. Full and open competition is not feasible. Purchase of the service through ImmixTechnology, Inc. is the only approach that meets this requirement. This sole source justification meets the requirements of FAR 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. III. Promotion of Future Competition The WDID is continually evaluating and integrating emerging technologies to provide capability to our warfighters.
