Description
In accordance with FAR 6.302, 6.305 and 5.2, this special notice advertises the government's award of an urgent contract modification to Hutchinson Construction LLC (contractor selected for award no. P12PC00598 in response to solicitation no. P12PS00598) for continuation of work without interruption to incorporate change order items agreed by the parties via a Contracting Officer's Written Directive issued 12/28/12. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $100,000 (See FAR 13.106-1) Date: 12/12/12 Requisition Number: R9500130030 Re: Contract no. P12PC00598, Modification no. 2 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): This is a modification to an existing contract which has been underway since September 2012. The project site is on a NatureBridge campus on the shore of Lake Crescent within Olympic National Park. NatureBridge offers meeting/conference space as well as operates an education/youth outreach program for approx. 4,000 students per year. The work of this modification involves a redesign of the south entrance court for the Rosemary Inn because the design in the contract did not meet ADA/ABA Guidelines due to varied existing grades discovered during survey. Consequently, a ramp is now required to access the classroom building that was not in the original contract. Recent heavy rains have demonstrated that there needs to be a redirection of some of the surface water to the drywell on the east because the drywell on the west is over capacity. Other changes include small reduction in square footage of lawn restoration area, small reduction in flexible paving, addition of a downspout, and changes to crushed rock paths (small reduction in square footage in one area, and in another area delete a section and replace with sod and stepping stones). Total modification price is $36,636.55, which will change the total contract price from $168,729.83 to $205,366.38. 2. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ___Other _____________________________ Explain: The existing contract is underway. The urgency of this modification is because NatureBridge did not have any students lined up for January, but in February has a full schedule of students coming to the campus. Construction of the south entry court blocks access to the only restroom available to the students. By allowing the contractor to complete the concrete/ramp work during January, there was no issue with students not having access to a restroom on campus because there were no students scheduled in January. It was simply not possible to push this work out into February or later, mainly because of the restroom access issue, but also because the NPS wanted to have the concrete and earth work completed before students were back on campus for safety. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: Market research was not done for this modification. The redesign of the south entry court was designed by NPS landscape architect and historical architect/accessibility coordinator. It is the design that best meets the ADA/ABA Guidelines, historic character preservation and the drainage problems. Utilizing the existing contractor was determined to be the most expeditious and cost effective way to meet NatureBridge,s time line. 4. If this is a determination for sole source, the Contracting Officer certifies: a. Only one source is available, or urgent and compelling circumstances exist. b.
