Description
The U.S. Nuclear Regulatory Commission intents to issue a sole source purchase order under the authority of 13.106-1(b) to: Safer Systems 23 Coachman Way Sherwood Park, Alberta, Canada T8H1C5 The objective of this order is to obtain contract support services from Safer Systems to: (1) maintain the off-the-shelf "Safer HAZMAT Responder" software package currently installed at the agency; (2) provide software program updates and enhancements to include major upgrades and new releases; (3) train NRC staff in the use of the software program; (4) provide technical support to NRC staff and; (5) allow for the option to purchase five additional software licenses of the software with upgrades and technical support as needed by NRC staff. The Office of Nuclear Material Safety and Safeguards, Division of Fuel Cycle Safety and Safeguards is responsible in the event of an accident at a fuel cycle facility to respond to ensure the protection of both public health and safety and the environment. Accidents at fuel cycle facilities that pose the greatest risk are chemical releases from the materials used in processing of source and special nuclear material. To access the real and potential consequences of accidents at fuel cycle facilities, the strengths of this type of proposed software program (i.e., Safer HAZMAT Responder) will provide in real time an analysis of the effects of the chemical release that update with time and changes in the weather. There is still an Agency need for the use of the software program; to include maintaining the software; updates/upgrades/ enhancements to the software; technical support; additional training; and the option to purchase additional licenses. The required software is proprietary and exclusive to Safer Systems. Further, Safer Systems has no authorized resellers of their software, and does not authorize any other firm to maintain or make adjustments to its very specialized software product. It would be impractical to have another firm develop the software specifically for the NRC as the Agency would incur a cost of approximately $1,500,000 if a new source had to develop the software. This figure does not include the retraining of staff which, depending on the number of users, could run into may thousands of dollars. This would be a duplication of effort since Safer Systems Services already has the required software. If the NRC is unable to obtain the required software, staff will be unable to adequately assess the effects of a chemical release from a fuel cycle facility in real-time. This would have a significant and detrimental effect on the ability of the agency to respond to requests for assistance by the Federal, State, and Local authorities for an independent assessment of the conditions on the ground. The estimated cost if the Government were to develop the software was based on extensive technical knowledge and experience of the Project Manager in the subject field. It should be noted that chemical dispersion software contains very detailed mathematical algorisms that are beyond the skill of average programmers and it is the software industry uses instead of building its own. Although a determination has been determined the award of this project is not urgent, it should be noted the current Safer Systems software the Agency currently uses will continue to operate on NRC's system as long as there are no significant changes to the Agency operating system (e.g., move to Windows 7). Please submit in writing to the Contracting Officer any objections or questions in regards to this intent to sole source within 15 days from this notice.
