ATTACHMENT #1 OF SOLICITATION SOLICITATION PACKAGE TO VIEW THIS SOLICITATION IN ITS ENTIRETY, UPLOAD THE SOLICITATION ATTACHMENT. SECTION A - SOLICITATION / CONTRACT FORM This is a COMBINED SYNOPSIS/SOLICITATION for commercial supplies and services for two milling machines and associated training for Camp Lejeune, North Carolina prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Government intends to award one contract as a result of this solicitation. The Government reserves the right to award without discussions, but reserves the right to engage in discussions if later determined to be in the best interest of the Government. A firm-fixed price contract will be awarded for this requirement. This acquisition will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items and FAR 15, Contracting by Negotiation. M67001-13-R-0007 is issued as a Request for Proposals (RFP) to provide the Government the Brand Name or Equal milling machines and associated training. The RFP documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-65, effective 29 January 2013 and DFARS Policy Notice (DPN) 20121231. The proposed acquisition is a 100% small business set-aside. The associated North American Industrial Classification System (NAICS) code for this requirement is 333517. Offerors must be registered in the System for Award Management (SAM) database. Information on registering in SAM may be obtained by calling (866) 606-8220 or via the internet at http://www.sam.gov. The provision at 52.212-1, Instructions to Offerors - Commercial Items applies to this acquisition. There are addenda to this provision identified in Section L of this solicitation. Camp Lejeune has a requirement for two vertical milling machines and associated training for 2nd Maintenance Battalion, General Support Company, Support Plt aboard Camp Lejeune, North Carolina. B.2 REQUIRED DELIVERY. The Government requires delivery and installation to be complete 8 weeks after receipt of order (ARO). Training is required within three (3) weeks after delivery/installation completion. B.3 SCHEDULE OF ITEMS. NOTICE TO OFFERORS: A mere statement that the offeror will meet the Government requirement is NOT sufficient. The vendor shall clearly state all product specifications for proposed items. This is a Brand Name or Equal requirement. The manufacturer's name and part/model number have been provided to describe equipment deemed capable of satisfying the Government's requirement. Further, the manufacturer names and part numbers are provided only to assist potential offerors in understanding the Government's requirement. The Government is not soliciting or suggesting a particular name brand and will consider quotes for any products of similar size, color, design, and quality as the products listed. The focus of the course will be on learning how to effectively use the WIPS system. It provides students with hands-on training and demonstrations. This shall be a one day, eight hour class for 1-5 students. The focus of the course is on learning how to effectively set up and program both the machine and 4th axis trunnion table. It provides students with hands-on training and demonstrations. This class shall be eight hours a day or a total of four days for 1-5 students. NET AMT TOTAL EXTENDED COST: tiny_mce_marker _______________________________________ SECTION C - DESCRIPTION / SPECIFICATIONS / STATEMENT OF WORK STATEMENT OF WORK FOR MILLING MACHINES AND TRAINING C.1 INTRODUCTION This requirement is for two vertical milling machines and associated training for the 22nd Maintenance Battalion, General Support Company, Support Plt, Camp Lejeune, North Carolina. The milling machines are required to repair the transmissions of Amphibious Assault Vehicles (AAV). C.2 BACKGROUND The Support Platoon is responsible to repair the AAV transmissions. The machine shop can repair the transmissions, in most cases, with the proper machine tools and software. The vertical milling machine is required to perform the complex machining repairs on the AAV transmissions. Such repairs cannot be completed in a convenient fashion without the Computer Aided Manufacturing (CAM) software. For the individual Marine to write the code required to perform the manufacture/repair of several different types of repair parts would take weeks. The CAM software will increase productivity by allowing the Marine machinist to set up and program the milling machine within a day. C.3 SCOPE OF WORK The increased capability that the milling machine would bring will provide the Marine machinist in the Intermediate Maintenance Activity the tools needed to maintain the advanced vehicle and weapon platforms the Marine Corps is moving towards. As the technological advancements in weapons, armor and transportation assets continues to keep our fighting forces on the cutting edge, so too must our Machinists have the ability to program complex parts and maintain the tolerance required to produce, repair and fabricate the parts needed by the war fighters. C.4. CONTRACTOR SPECIFICATONS C.4.1 DELIVERY. The contractor shall deliver all supplies directly to Building FC-286, 2nd Maint BN, General Support Company, Supt Plt aboard Camp Lejeune, North Carolina. Supplies shall be delivered at the time of installation. Tool certificate must be fulfilled within 30 days of machine installation. C.4.2 INSTALLATION. Deliver all supplies directly to the required building at time of installation. Temporary storage trailers/storage vehicles may be set up in vicinity of buildings (normally not on the grass or lawn), with locations as directed by Contracting Officer Representative (COR) or other authorized government representative. Cost of these storage trailers /vehicle are the full responsibility of the contractor. NO GOVERNMENT-OWNED WAREHOUSING OR STORAGE FACILITIES WILL BE PROVIDED. Contractor is advised to lock all storage vehicles/trailers and material handling equipment. The Government will not be liable for any stolen or damaged property that is left unsecured by the Contractor. C.4.2.1 Provide all necessary material handling equipment and tools required to support this requirement. C.4.2.2 The contractor shall be responsible for all damages resulting or done to the buildings and all grounds when moving or installing the furniture/furnishings. Damages shall be repaired and installed by contractor at the contractor's expense before final invoicing. C.4.3 TRAINING. The contractor shall provide the following training within three (3) weeks after completion of delivery and installation of all supplies. C.4.3.1 Training on Milling Machine System Contractor to provide training on an overview of proper use and techniques of the Intuitive Probing System (or equivalent). The training shall consist of understanding the basics in probing technology so that operators can make better use of the probing system in application and process probing on vertical machining center operations. The focus of the course will be on learning how to effectively use the WIPS system. It provides students with hands-on training and demonstrations. This shall be a one day, eight hour class for 1-5 students. C.4.3.2 Training on Milling Machine This course shall present an overview of proper techniques used while performing a milling set up and operation of a 4th axis. This class shall be eight hours a day or a total of four days for 1-5 students. C.4.4 DISPOSAL C.4.4.1 Packing Materials and Debris. Packing materials and all debris (with the exception of cardboard) shall be removed and disposed of off base at contractor's expense. The contractor is responsible for removal of all packing materials and debris from delivery and installation. Cardboard, plastic and wood may be delivered to Materials Recycling Facility (MRF) once a week maximum. C.4.4.2 Contractor shall provide all necessary material handling equipment and tools required to support this requirement. Contractor shall be responsible for securing all material handling equipment. The Government will not be liable for any stolen or damaged property that is left unsecured by the Contractor. C.5 CONTRACTOR REQUIREMENTS NMCARS SUBPART 5237.1-SERVICE CONTRACTS GENERAL 5237.102 Policy (a)(1)(S-90) The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the training via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil. F.2 REQUIRED DELIVERY. The Government requires completion of delivery and installation within eight (8) weeks after receipt of order (ARO). Training must be complete within three (3) weeks after delivery/installation. F.3. LOCATION. All items identified in Section C shall be delivered and installed in Building FC-286, 2nd Maint BN, General Support Company, Supt Plt aboard Camp Lejeune, North Carolina. SECTION G - CONTRACT ADMINISTRATION DATA G.1 ACCOUNTING AND APPROPRIATION DATA. To be shown on resulting contract. G.2 CONTRACT ADMINISTRATION OFFICE. a. Contractor shall invoice as reflected within Section B of the contract. Contractor shall invoice in accordance with DFARS clause 252.232-7006 of the resulting contract. Notice to Vendors: Delivery of supplies to any address other than the delivery address specified in the contract is not authorized without a contract modification signed by the Contracting Officer. Failure to deliver to the address in the contract will result in rejection of invoices and will cause delay in payment. G.4 OFFERORS PAYMENT ADDRESS. The offeror shall include the payment address in the proposal, if it is different from that shown for the offeror. SECTION H - SPECIAL CONTRACT REQUIREMENTS H.1 BASE ACCESS H.1.1 BUSINESS ACCESS SECURITY REQUIREMENTS. H.1.1 BUSINESS ACCESS DEFINITION. Contractor/subcontractor employees requiring installation access for periods from one day to one year to MCB, Camp Lejeune or MCAS New River, NC, must obtain a Business Access Identification Badge for that particular installation. Regularly scheduled delivery personnel, to include FEDEX, UPS, Pick-up and deliveries, should also follow the Business Access guidelines described below. Personnel requiring Business Access Identification Badges shall submit all documentation listed below. Badges are not required if the contracted position requires the employee to obtain a Common Access Card (CAC) which will be identified separately within the Government contract. H.1.2 INSTALLATION SECURITY ACCESS REQUIREMENTS. Contractor shall accomplish the security requirements below within 10 days after award or prior to performance under the contract. H.1.3 BUSINESS ACCESS IDENTIFICATION BADGE REQUIREMENT. The US Government will issue badges to contractor personnel without charge. Badges will be issued for one year or duration of contract whichever is less. In order to obtain a Business Access Identification Badge and access to MCB, Camp Lejeune, and satellite activities, or MCAS New River, all personnel providing services under this contract shall be required to present the documentation below to the following offices, as applicable: MCB, Camp Lejeune, NC and its satellite activities. Report as follows: 1. Identification Card Center, 59 Molly Pitcher Road for badge (910-451-2727). 2. Vehicle Registration Office, 60 Molly Pitcher Road for vehicle decal (910-451-1158). MCAS New River, NC. Report as follows: 1. S-4 (Facilities Office), Bldg AS-211 (1st Deck) for registration on contractor's list (910-449-6310). 2. Pass and Identification Office, Bldg AS-211 (1st Deck) for badge and vehicle decal (910-449-5427/5428). H.1.3.1 Photo ID. Valid state or federal issued picture identification card. Acceptable documents include state drivers license, DMV issued photo identification, or alien registration card. H.1.3.2 Proof of Employee Citizenship or Legal Alien Status. Acceptable documents include birth certificate, Social Security Card, Immigration and Naturalization Service (INS) forms and passports. H.1.3.3 Proof of Criminal Records Check. Proof of a criminal records check from the county or state where the employee has resided for the previous two years (or length of legal residence for foreign nationals in the U.S. for less than two years). Contractor employee background checks are conducted at Contractor's expense. Acceptable sources for criminal records checks include: County Courthouse; Defense Security Service (www.dss.mil); and Infolink Screening Services, Inc. (www.infolinkscreening.com). Criminal records check shall be conducted annually prior to renewal of badges for reevaluation. H.1.3.4 Denial of Access. Installation access shall be denied if it is determined that an employee: a. Is on the National Terrorist Watch List. b. Is illegally present in the United States. c. Is subject to an outstanding warrant. d. Has knowingly submitted an employment questionnaire with false or fraudulent information. e. Has been issued a debarment order and is currently banned from military installations. f. Is a Registered Sexual Offender and Convicted Felon (within the past 15 years); has a conviction of a drug crime within the past 5 years; and DUI within the last year. H1.1.3.5 Appeal Process. All appeals should be directed to the Base Inspector's Office for any individual that has been denied access to the Base. H.1.3.6 Display and Disposition of Badges. Contractor employees shall prominently display their badges on their person at all times. Upon completion or termination of a contract or an individual's employment, the Contractor shall collect and turn in badges to the Pass and ID Office from which it was issued. If the Contractor is unable to obtain the employee's badge for whatever reason, the cognizant Pass and ID Office will be notified within 24 hours. During the contract performance period contractors will immediately report instances of lost or stolen badges to the issuing Pass and Identification Office. H.1.3.7 Proof of Valid Government Contract. The Contracting Department shall submit a letter [on department letterhead] from the Contracting Officer to the Pass and Identification Office indicating location of contract work, contract period, and name of prime contractor. For subcontractors, the prime contractor will provide proof of employment on a valid Government contract (e.g., a letter [on company letterhead]) to include contract number and term. H.2 CONTRACTOR SECURITY REQUIREMENT BUSINESS ACCESS VERIFICATION FORM. Upon completion of the above process, Contractor shall submit to the Contracting Office the Contractor Security Requirement Business Access Verification form (provided at time of award) filled out in its entirety. H.3 CONTRACTOR AND SUBCONTRACTOR VEHICLE REQUIREMENTS. Each vehicle to be used in contract performance shall show the Contractor's or subcontractor's name so that it is clearly visible and shall always display a valid state license plate and safety inspection sticker. To obtain a vehicle decal, which will be valid for one year or contract period, whichever is shorter, Contractor or subcontractor vehicle operators shall provide: a. A copy of the Contracting Officer's authorization letter w/cc to PMO; b. A valid form of Federal or state government I.D.; c. If driving a motor vehicle, a valid driver's license, vehicle registration and proof of insurance. Upon completion/termination of this contract or an individual's employment, the Contractor shall collect and turn in to Vehicle Registration all Government vehicle decals. If any are not collected, the Contractor shall notify the Vehicle Registration Office within 24 hours. H.4 CONTRACTOR AND SUBCONTRACTOR EMPLOYEE VEHICLE REQUIREMENTS. In order to obtain a vehicle decal for one year, the Contractor and subcontractor employees shall provide to the Vehicle Registration office: a. A copy of the Contracting Officer's authorization letter w/cc to PMO; b. If any are not collected, the Contractor shall notify the Vehicle Registration Office within 24 hours. H.5 SECURITY CHECKS. Contractor personnel and vehicles shall only be present in locations relevant to contract performance. All Contractor personnel entering the base shall conform to all Government regulations and are subject to such checks as may be deemed necessary to ensure that violations do not occur. Employees shall not be permitted on base when such a check reveals that their presence would be detrimental to the security of the base. Subject to security regulations, the Government will allow access to an area for servicing equipment and/or performing required services. Upon request, the Contractor shall submit to the Contracting Officer questionnaires and other forms as may be required for security purposes. "Data qualifier" means a specified character (or string of characters) that immediately precedes a data field that defines the general category or intended use of the data that follows. "DoD recognized unique identification equivalent" means a unique identification method that is in commercial use and has been recognized by DoD. All DoD recognized unique identification equivalents are listed at http://www.acq.osd.mil/dpap/pdi/uid/iuid_equivalents.html. "DoD unique item identification" means a system of marking items delivered to DoD with unique item identifiers that have machine-readable data elements to distinguish an item from all other like and unlike items. For items that are serialized within the enterprise identifier, the unique item identifier shall include the data elements of the enterprise identifier and a unique serial number. For items that are serialized within the part, lot, or batch number within the enterprise identifier, the unique item identifier shall include the data elements of the enterprise identifier; the original part, lot, or batch number; and the serial number. "Enterprise" means the entity (e.g., a manufacturer or vendor) responsible for assigning unique item identifiers to items. "Enterprise identifier" means a code that is uniquely assigned to an enterprise by an issuing agency. "Government's unit acquisition cost" means- (1) For fixed-price type line, subline, or exhibit line items, the unit price identified in the contract at the time of delivery; (2) For cost-type or undefinitized line, subline, or exhibit line items, the Contractor's estimated fully burdened unit cost to the Government at the time of delivery; and (3) For items produced under a time-and-materials contract, the Contractor's estimated fully burdened unit cost to the Government at the time of delivery. "Issuing agency" means an organization responsible for assigning a globally unique identifier to an enterprise (i.e., Dun & Bradstreet's Data Universal Numbering System (DUNS) Number, GS1 Company Prefix, Allied Committee 135 NATO Commercial and Government Entity (NCAGE)/ Commercial and Government Entity (CAGE) Code, or the Coded Representation of the North American Telecommunications Industry Manufacturers, Suppliers, and Related Service Companies (ATIS-0322000) Number), European Health Industry Business Communication Council (EHIBCC) and Health Industry Business Communication Council (HIBCC)), as indicated in the Register of Issuing Agency Codes for ISO/IEC 15459, located at http://www.nen.nl/web/Normen-ontwikkelen/ISOIEC-15459-Issuing-Agency-Codes.htm. "Issuing agency code" means a code that designates the registration (or controlling) authority for the enterprise identifier. "Item" means a single hardware article or a single unit formed by a grouping of subassemblies, components, or constituent parts. "Lot or batch number" means an identifying number assigned by the enterprise to a designated group of items, usually referred to as either a lot or a batch, all of which were manufactured under identical conditions. "Machine-readable" means an automatic identification technology media, such as bar codes, contact memory buttons, radio frequency identification, or optical memory cards. "Original part number" means a combination of numbers or letters assigned by the enterprise at item creation to a class of items with the same form, fit, function, and interface. "Parent item" means the item assembly, intermediate component, or subassembly that has an embedded item with a unique item identifier or DoD recognized unique identification equivalent. "Serial number within the enterprise identifier" means a combination of numbers, letters, or symbols assigned by the enterprise to an item that provides for the differentiation of that item from any other like and unlike item and is never used again within the enterprise. "Serial number within the part, lot, or batch number" means a combination of numbers or letters assigned by the enterprise to an item that provides for the differentiation of that item from any other like item within a part, lot, or batch number assignment. "Serialization within the enterprise identifier" means each item produced is assigned a serial number that is unique among all the tangible items produced by the enterprise and is never used again. The enterprise is responsible for ensuring unique serialization within the enterprise identifier. "Serialization within the part, lot, or batch number" means each item of a particular part, lot, or batch number is assigned a unique serial number within that part, lot, or batch number assignment. The enterprise is responsible for ensuring unique serialization within the part, lot, or batch number within the enterprise identifier. "Unique item identifier" means a set of data elements marked on items that is globally unique and unambiguous. The term includes a concatenated unique item identifier or a DoD recognized unique identification equivalent. "Unique item identifier type" means a designator to indicate which method of uniquely identifying a part has been used. [If the Contracting Officer has identified end products and countries of origin in paragraph (i)(1) of this provision, then the offeror must certify to either (i)(2)(i) or (i)(2)(ii) by checking the appropriate block.] [_] (i) The offeror will not supply any end product listed in paragraph (i)(1) of this provision that was mined, produced, or manufactured in the corresponding country as listed for that product. [_] (ii) The offeror may supply an end product listed in paragraph (i)(1) of this provision that was mined, produced, or manufactured in the corresponding country as listed for that product. The offeror certifies that is has made a good faith effort to determine whether forced or indentured child labor was used to mine, produce, or manufacture any such end product furnished under this contract. On the basis of those efforts, the offeror certifies that it is not aware of any such use of child labor. (j) Place of manufacture. (Does not apply unless the solicitation is predominantly for the acquisition of manufactured end products.) (2) [_] Certain services as described in FAR 22.1003-4(d)(1). The offeror [_] does [_] does not certify that- (i) The services under the contract are offered and sold regularly to non-Governmental customers, and are provided by the offeror (or subcontractor in the case of an exempt subcontract) to the general public in substantial quantities in the course of normal business operations; (ii) The contract services will be furnished at prices that are, or are based on, established catalog or market prices (see FAR 22.1003-4(d)(2)(iii)); (iii) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract; and (iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers. (3) If paragraph (k)(1) or (k)(2) of this clause applies- (i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and (ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause. An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code 25 U.S.C. 7874. (2) Representation. By submission of its offer, the offeror represents that- (i) It is not an inverted domestic corporation; and (ii) It is not a subsidiary of an inverted domestic corporation. (o) Prohibition on contracting with entities engaging in certain activities or transactions relating to Iran. (1) The offeror shall email questions concerning sensitive technology to the Department of State at CISADA106@state.gov. (2) Representation and Certification. Unless a waiver is granted or an exception applies as provided in paragraph (o)(3) of this provision, by submission of its offer, the offeror- (i) Represents, to the best of its knowledge and belief, that the offeror does not export any sensitive technology to the government of Iran or any entities or individuals owned or controlled by, or acting on behalf or at the direction of, the government of Iran; (ii) Certifies that the offeror, or any person owned or controlled by the offeror, does not engage in any activities for which sanctions may be imposed under section 5 of the Iran Sanctions Act; and (iii) Certifies that the offeror, and any person owned or controlled by the offeror, does not knowingly engage in any transaction that exceeds $3,000 with Iran's Revolutionary Guard Corps or any of its officials, agents, or affiliates, the property and interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (50(U.S.C. 1701 et seq.) (End of Provision) K.1.1 252.212-7000 Offeror Representations and Certifications--Commercial Items. (a) Definitions. As used in this clause- (1) "Foreign person" means any person other than a United States person as defined in Section 16(2) of the Export Administration Act of 1979 (50 U.S.C. App. Sec. 2415). (2) "United States" means the 50 States, the District of Columbia, outlying areas, and the outer Continental Shelf as defined in 43 U.S.C. 1331. (3) "United States person" is defined in Section 16(2) of the Export Administration Act of 1979 and means any United States resident or national (other than an individual resident outside the United States and employed by other than a United States person), any domestic concern (including any permanent domestic establishment of any foreign concern), and any foreign subsidiary or affiliate (including any permanent foreign establishment) of any domestic concern which is controlled in fact by such domestic concern, as determined under regulations of the President. (b) Certification. By submitting this offer, the Offeror, if a foreign person, company or entity, certifies that it- (1) Does not comply with the Secondary Arab Boycott of Israel; and (2) Is not taking or knowingly agreeing to take any action, with respect to the Secondary Boycott of Israel by Arab countries, which 50 U.S.C. App. Sec. 2407(a) prohibits a United States person from taking. (c) Representation of Extent of Transportation by Sea. (This representation does not apply to solicitations for the direct purchase of ocean transportation services). (1) The Offeror shall indicate by checking the appropriate blank in paragraph (c)(2) of this provision whether transportation of supplies by sea is anticipated under the resultant contract. The term "supplies" is defined in the Transportation of Supplies by Sea clause of this solicitation. (2) Representation. The Offeror represents that it- ___________Does anticipate that supplies will be transported by sea in the performance of any contract or subcontract resulting from this solicitation. ___________Does not anticipate that supplies will be transported by sea in the performance of any contract or subcontract resulting from this solicitation. (3) Any contract resulting from this solicitation will include the Transportation of Supplies by Sea clause. If the Offeror represents that it will not use ocean transportation, the resulting contract will also include the Defense Federal Acquisition Regulation Supplement clause at 252.247-7024, Notification of Transportation of Supplies by Sea. (End of provision) SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS The provisions at FAR 52.212-1, Instructions to Offerors - Commercial Items (Feb 2012) applies to this acquisition. ADDENDUM TO 52.212-1 L.1 PREPARATION OF THE RESPONSE TO THE SOLICITAITON FOR COMMERCIAL ITEMS. Each offeror shall complete the following and submit as part of their proposal: (a) Technical Proposal- No identifying information shall be present on any page of the technical proposal except the cover page. Failure to follow this instruction may result in rejection of your proposal. (b) Price/Proposal shall be submitted on the unaltered Section B of this solicitation and shall include the completed and signed solicitation for commercial items (c) Past Performance References (d) Representations and Certifications. The offeror shall include completed copies of the representations and certifications as required by Section K, Paragraph K.1. L.1.1 THE TECHNICAL PROPOSAL. The Technical Proposal must demonstrate Contractor's knowledge, experience and understanding of the requirements outlined in the Statement of Work. The Government requires complete delivery and installation of "Schedule of Items" no later than eight (8) weeks after receipt of order (ARO). Training shall be conducted within three (3) weeks after completion of delivery and installation. The following information must be provided with your proposal as it will be used to determine technical acceptability: a) Complete specifications for each item being proposed to include proposed manufacturer names and part numbers; b) Product literature, drawings, and pictures of furniture and items being offered; c) All terms of applicable warranties; d) Delivery/Installation Schedule: The Government requires completion of delivery and installation to the location identified in Paragraph 3 above, no later than eight (8) weeks after receipt of order (ARO). Offerors shall clearly state delivery and installation completion time frame for the project, specified in terms of days "after receipt of order". Training in CLINs 0006 and 0007 shall be conducted within three (3) e) weeks after completion of delivery and installation of supplies. QUANTITIES LESS THAN SPECIFIED. Offers may not be submitted for less than the quantities specified in the schedule. IF YOUR PROPOSAL DOES NOT ADDRESS ALL OF THE ABOVE REQUIREMENTS, IT WILL BE DETERMINED TO BE TECHNICALLY UNACCEPTABLE AND, THEREFORE, NOT ELIGIBILE FOR AWARD. L.1.2 PAST PERFORMANCE INFORMATION. The offeror shall provide at least three (3) relevant past performance references. Relevant past performance is defined as performance of contracts of similar size, scope and complexity within the past three (3) years. For the purpose of this Request for Proposal (RFP), "similar in scope" means the provision, delivery and installation of a similar quantity and quality of furniture. Reference information shall include the following for which your firm has provided same/similar services or supplies. • agency name • contract number(s) • dollar value • brief description of the work completed • point of contact information (to include email address) To obtain past performance information, the Government will send out a Past Performance Questionnaire to the offeror's references. Make sure your reference information is up to date. DO NOT GIVE THE NAME OF REFERENCES UNLESS YOU HAVE MADE SURE THAT THE INDIVIDUAL CAN BE REACHED AT THE REFERENCED TELEPHONE NUMBER, E-MAIL ADDRESS, OR POSTAL ADDRESS THAT YOU HAVE PROVIDED. Note: The Government may supplement the information provided by the Offeror's with any other information it may obtain from other source including its own experience with an Offeror's firm, or information concerning Offeror's performance from any other reliable source. L.1.3 THE PRICE PROPOSAL. Offerors shall provide pricing for each Contract Line Item Number (CLIN) utilizing the unaltered Section B "Schedule of Items" of this solicitation. L.2 QUESTIONS. Questions related to this RFP shall be submitted, in writing or via electronic mail, to the Contracting Division and received no later than, 12:00 PM EDT, Thursday, 14 February 2013. Questions received after 12:00 PM EDT, Thursday, 14 February 2013 will not be considered. Therefore, review the RFP and these instructions thoroughly so all of your concerns/questions can be addressed. It is solely the Contractor's responsibility to ensure questions are received within the required time frame. Questions may be submitted in writing via email to monica.curley@usmc.mil; or via facsimile to 910-451-2332 Attn: Monica Curley. L.3 SUBMISSION OF PROPOSALS: Proposals related to this RFP shall be received by the Contracting Department by 12:00 p.m., EDT, Wednesday, 27 February 2013, to be considered for award. The information submitted shall be clear and legible (Note: repetitively copied data loses its clarity and legibility.) Proposals may be submitted via email to monica.curley@usmc.mil; via facsimile to 910-451-2332 Attn: Monica Curley; or via courier to Contracting Department, Bldg 1116, Camp Lejeune, NC 28542. Submitted proposals must reflect Technical, Past Performance, and Price as described in Section M. It is solely the Contractor's responsibility to ensure proposals are received within the required timeframe. SECTION M - EVALUATION FACTORS FOR AWARD M.1 BASIS FOR AWARD. The Government intends to make award to the lowest priced, technically acceptable offeror that possesses a relevant, satisfactory performance record. In accordance with FAR Part 12.206 Past Performance will be evaluated. The Government reserves the right to award to other than the lowest priced, technically acceptable offeror when the offeror's past performance record demonstrates anything other than satisfactory performance. The Government intends to evaluate proposals and select an offer based on the initial evaluation of proposals received in response to the solicitation. Therefore, offerors are cautioned that their initial proposals should contain their best terms from a technical and price standpoint. In accordance with FAR 52.212-2, the evaluation criteria that will be used for/applied to all proposals received in response to this solicitation are: (1) Technical Capability, (2) Past Performance, and (3) Price. All responsible sources may submit a response which, if timely received, will be considered by the agency. All timely proposals will be evaluated and an award will be made without discussion with vendors, unless discussions are determined to be necessary. M.1.1 FACTOR #1 - TECHNICAL. A mere statement that the vendor will meet the Government requirement is NOT sufficient. The proposal will be evaluated to determine if the offeror possesses the capability required to successfully perform the requirements of the solicitation. Proposals are evaluated for acceptability but not ranked using non-cost/price factors. Technical capability will be evaluated on contract requirements listed in Sections B and C of this solicitation (See Section L for instructions to offerors ). Offers will be evaluated first on price. The lowest price offer will be evaluated for technical acceptability and satisfactory past performance. When an offer is determined to technically acceptable with satisfactory past performance, no further evaluations will be conducted and award will be made to that offeror. M.1.2 FACTOR #2 - PAST PERFORMANCE. Offeror(s) shall submit information as indicated in Section L, Paragraph L.1.2 in this solicitation. Information provided in the proposal shall include similar contracts with Federal, State, and local governments, as well as commercial businesses. Similar contracts are defined as those similar in scope, magnitude, and complexity to this procurement. M.1.2.1 Performance Evaluation. The Government will evaluate the offeror's, and (if applicable) its principal subcontractors' demonstrated past performance in delivering quality services and in meeting schedule requirements on similar programs. The performance risk assessment will address the probability of the offeror successfully accomplishing the contract requirements based on relevant past performance. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor's performance will be considered. Problems not addressed by the offeror will be considered to still exist. Each offeror will be evaluated to the extent to which they demonstrate satisfactory performance on contracts or subcontracts currently ongoing or completed within the last three (3) years. References other than those identified by the offeror may be contacted by the Government and used in evaluating the offeror's past performance. Past performance is an indicator of how current and/or previous customers assess contractor performance under a specific contract performed for them and address the full range of all functions required to make any contractual relationship work. Successful past performance indicates that a contractor understands and has the resources to successfully execute a contract; however, it does not necessarily mean a contractor has the resources and skills necessary to perform the specific work requirements of this solicitation. Evaluation of past performance will be based on consideration of all relevant facts and circumstances. The evaluation will include demonstrated past performance in quality of product or service, schedule, business relations, and customer satisfaction. The following table identifies the adjectival ratings and descriptions utilized in rating past performance history: ADJECTIVAL RATING DEFINITION Satisfactory Performance MET contractual requirements. Unsatisfactory Performance DID NOT MEET contractual requirements. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance. Offerors without a record of relevant past performance will receive a "neutral" rating, that will have neither a positive nor negative effect. If there is no record of relevant past performance, offerors must affirmatively state this. M.1.3 FACTOR #3 - PRICE. Offerors shall submit price/proposal as indicated in Section L, Paragraph L.1.3 in this solicitation. Award will be made on the basis of the lowest priced, technically acceptable offeror.
