Description
DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: The agency responsible for this acquisition is: The Department of Veterans Affairs, VISN 17, 1901 S. 1st Street, Temple, TX 76504. The Contracting Officer for this procurement is Rachelle Moore. The Department of Veteran Affairs proposes to enter into a contract on the basis of other than full and open competition for a single site membership license to Health Devices Gold. Purchase Request Number 674-13-1-038-0001. 2. Nature and/or Description of Action Being Processed: This is a request for other than full and open competition. The proposed action is to provide a single site membership license to Health Devices Gold, required by the Central Texas Health Care System, Temple, TX. Network Contracting Office (NCO) 17 intends to negotiate and award a contract on a sole source basis to The Emergency Care Research Institute (ECRI), 5200 Butler Pike, Plymouth Meeting, PA 19462-1928. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Library Service Department at the Central Texas VA Medical Center's has a request to provide a single site membership license to Health Devices Gold which is provided by ECRI. The base period of performance is 01/01/2013 - 12/31/2013, option period 1: 01/01/2014 - 12/31/2014, option period 2: 01/01/2015 - 12/31/2015, option period 3: 01/01/2016 - 12/31/2016, and option period 4: 01/01/2017 - 12/31/2017. The total estimated value of the proposed action is $35,900.00. 4. Statutory Authority Premitting Other than Full and Open Competition: 41 USC §253(c) (1), as implemented by FAR 6.302.1 (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): ECRI Institute is a nonprofit organization of applied scientific research to discover which medical procedures, devices, drugs, and processes are best to improve patient care. ECRI provides research, information, and advice in a variety of ways, including customized consulting and collaboration, memberships, publications - journals, alerts, resource guides, newsletters, collecting and analyzing patient safety data, and investigations. ECRI Institute is the sole and proprietary provider of the research offered through ECRI membership programs; and owns full copyright for the published materials. 6. Description of Efforts made to ensure that offers are solicited from as many potential sources as deemed practicable: Market Research was conducted by the using service. No other contractors were identified that could provide a single site membership license to Health Devices Gold or a membership license similar to ECRI's membership. The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: In accordance with FAR 13.106-3(a)(2) the Contracting Officer shall determine pricing fair and reasonable based on the vendor's published price list. The requirements of FAR 15.406-2, Certificate of Current Cost or Pricing Data are not applicable to this acquisition. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted in accordance with FAR Part 10, by searching the General Service Administration (GSA) e-Library and National Acquisition Center (NAC) website using the Keyword Emergency Care Research Institute to determine if the requirement could be procured pursuant to FAR 8.002(a)(1) by mandatory sources. The search results determined that ECRI does not have a GSA FSS or VA FSS Contract. On December 6, 2012, a search on the VetBiz.gov database (https://www.vetbiz.gov) using North American Industry Classification System (NAICS) Code 519130 and the keyword Emergency Care Research Institute was conducted, no matches were identified. On December 6, 2012, VA conducted a Small Business Administration (SBA) Quick Market Search (https://www.dsbs.sba.gov/dsbs/search/dsp_quicksearch.cfm) using the North American Industry Classification System (NAICS) Code 519130 and the keyword ECRI, no matches were identified. As such, this effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be made available within 30 days of contract award on the Federal Business Opportunities Page in accordance with FAR 6.305. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: There are no other sources but the proposed. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.
