NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED The action to be awarded will be a modification to existing contract FA2521-08-C-8002, a firm-fixed price (FFP) contract which will provide a six-month performance extension for the Materials Technology Support (MTS) contract. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The Air Force Technical Applications Center (AFTAC) has a requirement for sustained and uninterrupted MTS support services. These services are primarily concerned with Quality Assurance (QA) data management support, nuclear sciences consultation support, and radiological health and safety services. These services are an integral part of AFTAC's MTS support. Uninterrupted support is critical to the success of this program. Services to be provided are not commercial in nature. The period of performance anticipated by this J&A will be 01 Oct 12 through 31 Mar 13, the six months covered by FAR 52.217-8, Option to Extend Services, included in Section I of the current contract. The use of this option will fulfill the government's need for continuity of services and will eliminate costs associated with disrupting operations. A disruption of services could cause a severe impact to AFTAC's capability to perform their mission. It is anticipated that award of the follow-on contract can be made by 01 Apr 13. For over six months the using activity has been attempting to hire two additional civilian positions. This lack of personnel has resulted in a large increased workload for the project officer that has caused a delay in the processing of required documents for the follow-on acquisition. The required documents have now been received for the follow-on acquisition, so it is anticipated that the 6-month extension on the current contract will be sufficient to make award of the follow-on. The estimated cost of the 6-month extension is $322,939.50 for MTS support services and $41,826.00 for travel, using 3400 operation and maintenance (O&M) funds. These amounts are based on prices currently specified in the contract. It is the intent that the option provision be exercised for the entire 6-month period. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Services are available from only one responsible source, and no other services will satisfy agency requirements". V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Pursuant to FAR 6.302-1(a)(2)(iii)(B), the services to be acquired are determined to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements. The highly specialized services to be acquired are primarily concerned with Quality Assurance (QA) data management support, nuclear science consultation support, and radiological health and safety services. Zel Tech is currently performing these services on contract FA2521-08-C-8002, which was awarded on a competitive basis on 1 Nov 07. That contract will end 30 Sep 12. This is a bridge effort is to be awarded for a total of 6 months. Therefore, this acquisition is for continued performance of highly specialized services. The contractor, Zel Technologies, has highly specialized capabilities and qualification to support the 6-month extension and has been doing so since Nov 07. These capabilities and qualifications include field test and demonstration planning for the integration of advanced technology sensor systems into various field-test deployments, joint military exercises and demonstrations. Quality assurance and technical writing support has been provided to TM's Atmospheric Sciences Division. They also support air operations planning which supports the integration of advanced technology sensor systems. The contractor also maintains active consulting agreements with technical experts in a variety of fields. The AFTAC/TMNV directorate believes that award to any other source would result in unacceptable delays in fulfulling the Air Force's requirements. The time delay could be approximately six months to a year due to training and familiarity required to perform the services of the MTS contract. This is based upon recent and comparable experience in getting and indoctrinating qualified, cleared personnel to support the Material Technology (TM) program. An entirely new, unfamiliar staff to support this program would result in critical delays in field test and demonstration planning, nuclear sciences consultation support, and radiological health and safety services. Accordingly, Zel Technologies is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfulling its requirements. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Sources Sought Synopsis. The sources sought synopsis (SSS) (FA7022-12-R-0004) that was published on the Federal Business Opportunities (FedBizOps) website on 07 Feb 12 (Attachment 1) was for the follow-on acquisition, and included the services to be acquired by this effort as services to be performed during this time frame were initially intended to be included in the follow-on contract. A copy is attached. As a result of the SSS, capabilities statements were submitted by 5 companies: Zel Tech of Hampton, VA, Micro GLOBE, LLC of Atlanta, GA, Science Applications International Corporation (SAIC) of McLean, VA, 5-D Systems, Inc. of Huntsville, AL, and Oak Ridge Associated Universities of Oak Ridge, TN. Attached are copies of the statements received. It was determined that the Micro GLOBE, LLC company was not capable, as, based on review of the information they provided, they only provide security system integration and IT infrastructure services The remaining 4 respondents appear to be capable of performing these services; however, they still don't have the highly specialized capabilities and qualifications to perform the services without time delays. The government feels that bringing a new contractor on board would result in time delays unacceptable to the mission. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE In accordance with FAR clause 52.217-8, Option to Extend Services, the costs associated with continued performance are within the limits and at the rates specified in the contract. The contract costs were determined to be fair and reasonable based on the following methods: a comparison of the current and previous labor rates showed current rates are the same or lower; indirect rates are lower or IAW DCAA rates; the travel costs are consistent with the current travel costs; and the profit rate is consistent with the negotiated rate at contract award. The current circumstances for these particular services are deemed no different than that at the time of contract award. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED The market research was conducted primarily by validating market research conducted for the follow-on acquisition. This was conducted by a synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. That market research was deemed to be sufficiently accurate and valid to support a contract modification to extend the period of performance of the current contract for an additional 6 months. The market research concluded, with a high level of confidence, that no other qualified sources exist to support the 6 month extension (see para. VI.). IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION Not applicable X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION See Section VI above. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED Zel Tech has been an integral part of the AFTAC's material technology support services since the inception in the early 1990s and has developed an unequaled capability over that period. Although the 6-month extension will not be competed, the follow-on acquisition will be competitive, with a planned award date of 01 April 2013. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief. XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
