Description
Justification for Other than Full and Open Competition Department of Labor/Office of Procurement Services 1. Nature and/or description of the action being approved. The U.S, Department of Labor Office of Procurement Services will award a subscription to StateNet, a product of Information for Public Affairs, Inc. supporting the Employment and Training Administration, Office of Unemployment Insurance (UI). 2. A description of the supplies or services required to meet the agency's needs (including the estimated value including all options). Statenet is an online database that tracks and reports all state and federal Unemployment Insurance legislation from introduction to enactment on a daily basis. Statenet also provides online customized UI regulatory screening, status, and summaries, as well as the yearly state legislative sessions. Statenet is used by the Division of Legislation to efficiently monitor UI state and federal legislative activity, to review proposed and enacted laws for conformity and compliance and to access the National State Net Capitol Journal. The government cost estimate is $. 3. An identification of the statutory authority permitting other than full and open competition. 48 CFR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. 4. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. StateNet provides state legislative information - bill text and status in the legislative process-and customized reports based on client needs. These customized reports are created via StateNet's unique search engines and the expertise of issue analysts. Products of other companies aren't comparable because they do not have issue analysts and because their information is not available as quickly as StateNet's information. (Since other companies buy some of the information that StateNet gathers, StateNet customers can access this information at least a day earlier than customers of other companies.) In order for the Division of Legislation to do its job, it is essential to get updated, accurate state legislation information as quickly as possible. Only StateNet can meet these needs. For these reasons, we have been contracting with StateNet for many years. StateNet has provided us with an excellent service that meets all of our needs. 5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. The Office of Unemployment Insurance needs a subscription to StateNet because it provides a service necessary to efficiently monitor UI state and federal legislative activity, to review proposed and enacted laws for conformity and compliance and to access the National State Net Capitol Journal. Although we have researched other companies' offerings, no one offers what StateNet does. 6. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The service is valued at $ per year and DOL anticipates an award price of $, a discount of $ for renewal of the subscription. 7. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. The Office of Unemployment Insurance surveyed the internet to determine that no other service provides comparable information and services. StateNet provides state legislative information - bill text and status in the legislative process-and customized reports based on client needs. These customized reports are created via StateNet's unique search engines and the expertise of issue analysts. Products of other companies are not comparable because they do not have issue analysts and because their information is not available as quickly as StateNet's information. (Since other companies buy some of the information that StateNet gathers, StateNet customers can access this information at least a day earlier than customers of other companies.) 8. Any other facts supporting the use of other than full and open competition, such as: (i)Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. This is a commercial service so technical specifications are proprietary and not available for publication. 9. A listing of the sources, if any, that expressed in writing, an interest in the acquisition. None 10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. This justification supports a one year subscription. Before renewing the subscription for another year, the Office of Unemployment Insurance will survey the market to determine if competing services have become available. If one or more competing services become available the requirement will be competed.
