- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Requesting agency and contracting activity: The requesting agency is the National Weather Service (NWS), National Oceanic and Atmospheric Administration (NOAA), Department of Commerce. The contracting activity is the NOAA Acquisition and Grants Office (AGO). 2. Nature and/or description of the action being approved: This is a request to extend contract DG133-10-SE-3487 to fulfill critical work underway at NWS. As described below, the work involves acquisition support a part of the NextGen Weather Program that is being subsumed under the NWS Integrated Dissemination Program (IDP). The NWS IDP is about to release a critical request for proposals for contract services to re design, develop and implement critical dissemination capabilities. A temporary extension of specialized support integral to the development of IDP is thus sought (under contract DG133-10-SE-3487) in order for NWS to complete this process economically and efficiently. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value): The contractor, P3 Solutions will provide independent cost estimate as at part of the acquisition planning cycle for IDP. Given their past work with NextGen cost estimation work, now part of IDP, their intellectual knowledge is needed to complete this critical work for the program. The work is approximated at $90K. 4. An identification of the statutory authority permitting other than full and open competition: FAR, Part 6-302-1 - Only one known responsible source. 5. Demonstration the proposed contractor's unique qualifications or the nature of the acquisition requires use of authority cited: intent to make a sole source award to P3 Solutions, has provided cost estimation and acquisition support to the NextGen Weather Program, as well as program management and cost estimation to other parts of NWS. The portion of the NextGen Weather Program is a key component of the IDP, and as such, P3 Solutions has developed and now possesses an in-depth, unique and extensive set of knowledge and skills needed by NWS in advancing IDP, without considerable time delways and additional costs. 6. A description of efforts made to ensure offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: The current services were procured competitively and follow-on work will be sought via competitive mechanisms. This justification will be made publically available in accordance with FAR 5.203 and 6.305(a). 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: A determination to see if the cost is fair and reasonable will be made by the Contracting Officer at time of award. 8. Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Market research was conducted on the current contract and there is no known company that can step in the shoes of the current workforce and perform the work on the schedules imposed upon these this program. 9. Any other facts supporting the use of other than full and open competition. N/A 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: None. 11. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: N/A. No subsequent acquisition is required after this service is rendered. 12. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief: The contracting officer's signature on the first page of this justification constitutes certification.
