- Hotel Price Schedule Ombudsman Document Attachment B to Hotel SOW Attachment A to Hotel SOW Statement of Work The U.S. Coast Guard Research & Development Center has a requirement for hotel rooms to be used by the USCG International Ice Patrol during their temporary duty assignments to St. John's, Newfoundland, Canada on Ice Reconnaissance Detachment Patrols. ***RECEIPT OF QUOTES REQUIRED NO LATER THAN: 11 Jan 2013; 2:00PM EST*** This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; firm-fixed-price quotes for the purchase of the following item(s) are being requested and a written solicitation will not be issued. This Request for Quote HSCG32-13-Q-SAP006 incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-60. The North American Industry Classification System Code is 721110. This is an unrestricted procurement. The U.S. Coast Guard (USCG), Research & Development Center intends to issue a Firm Fixed Price Purchase Order using the procedures of FAR Part 12 and Part 13. The anticipated award date is on or about 18 Jan 2013. The government intends to award from this solicitation to the responsive vendor whose quote conforming to the solicitation provides the best value. CENTRAL CONTRACTOR REGISTRATION (CCR): As required by Federal Acquisition Regulation (FAR) Clause 52.204.-7, the prospective contractors shall be registered in the government's CCR database prior to award of a contract. Before a company may register itself in CCR, it must have a Data Universal Numbering System (DUNS) number. Dun & Bradstreet, Inc issues this 9-digit DUNS number that uniquely identifies each business entity. A DUNS number may be requested via the Internet at www.dnb.com. Upon a DUNS number being issued, you may then register your company in the CCR database via the Internet at www.ccr.gov or by at phone at 1-888-227-2423. ONLINE REPRESENTATIONS AND CERTIFICATIONS APPLICATION (ORCA): Prospective contractors shall complete their annual representations and certifications electronically at http://ocra.bpn.gov in compliance with FAR Clause 52.212-3. PLEASE NOTE: Failure to comply with FAR Clauses 52.204-7 and 52.212-3 may impact eligibility for award. DESCRIPTION OF WORK: Provide Hotel rooms to US Coast Guard members during their temporary duty assignments to St. John's, Newfoundland, Canada on Ice Reconnaissance Detachment Patrols. CONTRACT CLAUSES 52.212-2 Evaluation-Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. The following factor shall be used to evaluate offers: Price: (b) Options: The Government wil evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) FAR 52.204-7 Central Contract Registration (APR 2008) 52.209-10 Prohibition on Contracting with Inverted Domestic Corporations. As prescribed in 9.108-5(b), insert the following clause: PROHIBITION ON CONTRACTING WITH INVERTED DOMESTIC CORPORATIONS (MAY 2012) (a) Definitions. As used in this clause- "Inverted Domestic Corporation" means a foreign incorporated entity which is treated as an inverted domestic corporation Under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code at 26 U.S.C. 7874. "Subsidiary" means an entity in which more than 50 percent of the entity is owned- (1) Directly by a parent corporation; or (2) Through another subsidiary of a parent corporation. (b) If the contractor reorganizes as an inverted domestic corporation or becomes a subsidiary of an inverted domestic corporation at any time during the period of performance of this contract, the Government may be prohibited from paying for Contractor activities performed after the date when it becomes an inverted domestic corporation or subsidiary. The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action nunder this clause. (c) Exceptions to this prohibition are located at 9.108-2. (End of clause) FAR 52.212-3 Offeror Representations and Certifications-Commercial Items (Mar 2011) An offeror shall complete only paragraph (j) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (i) of this provision. As prescribed in 22.202, insert the following clause: CONVICT LABOR (JUNE 2003) (a) Except as provided in paragraph (b) of this clause, the Contractor shall not employ in the performance of this contract any person undergoing a sentence of imprisonment imposed by any court of a State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, or the U.S. Virgin Islands. (b) The Contractor is not prohibited from employing persons- (1) On parole or probation to work at paid employment during the term of their sentence; (2) Who have been pardoned or who have served their terms; or (3) Confined for violation of the laws of any of the States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, or the U.S. Virgin Islands who are authorized to work at paid employment in the community under the laws of such jurisdiction, if- (i) The worker is paid or is in an approved work training program on a voluntary basis; (ii) Representatives of local union central bodies or similar labor union organizations have been consulted; (iii) Such paid employment will not result in the displacement of employed workers, or be applied in skills, crafts, or trades in which there is a surplus of available gainful labor in the locality, or impair existing contracts for services; (iv) The rates of pay and other conditions of employment will not be less than those paid or provided for work of a similar nature in the locality in which the work is being performed; and (v) The Attorney General of the United States has certified that the work-release laws or regulations of the jurisdiction involved are in conformity with the requirements of Executive Order 11755, as amended by Executive Orders 12608 and 12943.
