- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 8, Gainesville VA Medical Center The North Florida/South Georgia Veterans Health System (NFSGVHS). 2.Nature and/or Description of the Action Being Processed: The NFSGVHS has an ongoing need for Home Oxygen Services for approximately 1,900 home oxygen-using patients. This need is currently being met by contract, VA248-12-0-0145 with Commonwealth Home Health Care, Inc., which ends on 11/30/2012. The solicitation for a new Home Oxygen contract is currently undergoing final revisions and the FedBizOpps posting is forthcoming. In order to allow for uninterrupted care provision and unacceptable delays in fulfilling the agency's requirements, a 2-month Interim Home Oxygen is required. It has been determined that this can only be accomplished through a sole-source award, in accordance with Federal Acquisition Regulation 6.302-1(a)(2)(ii), to incumbent contractor, Commonwealth Home Health Care, Inc. for a 2-month period of performance of 12/1/2012- 1/31/2013. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Home Oxygen Services are required for the 2-month Interim Contract at a total estimated value of $425,635.00. The period of performance for this interim Home Oxygen contract is 12/1/2012 - 1/31/2013. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The rationale for this 2-month Interim Home Oxygen contract is to reduce potential harm to the Government that an interruption of patient care could cause, as well as the substantial duplication of cost to the Government that is not expected to be recovered through competition. Additionally, in order to avoid unacceptable delays in fulfilling the agency's requirements, a 2-month Interim Home Oxygen is required, which will provide the additional time required to complete the posting and award of a new contract. Accordingly, it has been determined that this can only be accomplished through a sole-source award, in accordance with Federal Acquisition Regulation 6.302-1(a)(2)(11), to incumbent contractor, Commonwealth Home Health Care, Inc. for a 2-month period of performance of 12/1/2012 - 1/31/2013. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Facilitating competition for this acquisition was not deemed practicable as the probability of avoiding a break in the provision of these vital services was deemed to be low and the potential of encountering unacceptable delays in fulfilling the agency's requirements was deemed to be high, should another contractor attempt to transition/take-over this requirement from the incumbent for this 2-month period of performance, at this time. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost for this interim contract is considered fair and reasonable as it is in agreement with pricing for the current contract, which was already determined to be both fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The rationale for not conducting market research for this 2-month interim Home Oxygen contract is addressed in #'s 2, 5, and 6 above. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before making subsequent acquisitions for the supplies or services required: Competition for a new Home Oxygen contract is being sought through the posting of the solicitation for that specific requirement, anticipated for release on FedBizOpps, on or before 12/3/2012. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
