- As was stated in the original sources sought the government does not own any infrastructure to support this requirement. Through review of the current franchise agreement and license agreement that the government has with Comcast Inc. it has been determined the government has no legal right of ownership to the infrastructure that is currently being used and cannot allow competing offerors to use said infrastructure. This determination was made by the Hill AFB Staff Judge Advocate's Office. Due to this determination the government will be negotiating a new contract on a sole source basis with Comcast Inc. The justification for the sole source nature of the acquisition will be the duplication of cost involved for competing offerors to install all brand new infrastructure. The government will generate and post all appropriate Sole Source justifications at a later date in a separate annoucement from this Sources Sought. In order to facilitate competition in the future for this requirement the government plans to purchase the rights to all infrastructure from the point the infrastructure enters each building. This requirement will be available for bid at the expiration of the newly negotiated franchise and license agreements with Comcast Inc.
