- DOL Wage Determination Attachment C - Quality Assurance Surveillance Plan Attachment F - Questions & Answers # 1 Attachment E - Schedule of Items Attachment A - Experience Questionnaire form This is a combined synopsis/solicitation for a commercial service item prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation number AG-03R6-S-13-0010 is issued as a Request for Quotation (RFQ). The awarded contract will be a firm fixed price contract. The Western Montana Acquisition Zone (WMAZ) serves as the Forest Service contracting office for Western Montana and is located in Building 24, Fort Missoula, Missoula, Montana 59804. The Bitterroot National Forest has a requirement for janitorial Services for the Supervisor's Office, the Warehouse/Garage, and the Aviation/Dispatch Facility. The Supervisor's Office and Garage/Warehouse are located at 1801 North First Street while the Aviation/Dispatch Facility is located at 533 Airport Road, both in Hamilton, Montana. The contractor shall provide all management, labor, tools, equipment, cleaning supplies and incidentals necessary to ensure that custodial services are performed in accordance with the solicitation requirements. The area to be cleaned is approximately 27,925 square feet divided into 3 separate buildings occupying two locations. This acquisition is a 100% Small Business set-aside. The applicable NAICS code is 561720- Janitorial Services. The corresponding size standard is $16.5 million. Offerors will be evaluated on price, technical capability and experience, and past performance. The Contract will be awarded to the offeror whose submittal, in compliance with the solicitation, is the best value to the Government. The FAR provision at 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. Offers submitted must include past performance information, technical experience information (complete Experience Questionaire, site specific Quality Control Plan), and price (complete Schedule of Items). Provide references for similar work during the past three years. Specifically include experience with janitorial services. GENERAL SPECIFICATIONS SCOPE OF CONTRACT This contract is for janitorial services for the Forest Supervisor's Office, Warehouse/Garage, and Aviation & Dispatch Facility of the Bitterroot National Forest. Contractor shall furnish all labor, equipment, supervision, supplies (except those designated as Government-furnished), and incidentals to perform all work necessary to clean and maintain the buildings in accordance with the specifications, terms, and conditions of this contract. DESCRIPTION AND LOCATION The Forest Supervior's Office and Warehouse/Garage is located 1801 N 1st Street in Hamilton, Montana. The Aviation & Dispatch Facility is located at 533 Airport Road in Hamilton, Montana. The janitorial services are required for the following: ADMINISTRATION BUILDING: The office area consists of approximately 20,400 SF of office, conference room, reception, storage areas four restrooms, employee lunchroom, and a kitchen area. All areas are carpeted except the restrooms, storage rooms, and foyer, which are tile. GARAGE/WAREHOUSE BUILDING: The garage/warehouse area consists of approximately 5,325 SF of offices, three storage rooms, and two restrooms with showers. The offices and one storage room are carpeted. The restrooms and other storage areas are tiled. AVIATION/DISPATCH FACILITY: This office consists of approximately 2600 SF of offices, training/conference room, storage areas, two restrooms, and a kitchen/reception area. All areas are carpeted except the restrooms, storage rooms, and foyer, which are tile. SITE VISIT: A site visit is planned for this project for Tuesday, December 12, 2012 at 10 am, at the Forest Supervisor's Office in Hamilton, Montana. PERFORMANCE BASED SERVICE CONTRACT: This work is being solicited as a performance based, commericial item contract. Performance based means the Contractor is responsible for an end product. If an end product is not provided, an adjustment to the payment will be made. A commercial item contract streamlines the terms and conditions to resemble those already used in the everyday marketplace. • See Attachment B - Wage Determination MAINTENANCE PROBLEMS: The Contractor shall notify the Contracting Officer immediately of any building or grounds maintenance problems such as slow or clogged drains, broken pipes, locks or doors that do not close properly. Notification shall be done by phone and/or by written notice depending on the urgency of the problem. GOVERNMENT-FURNISHED PROPERTY: The Government will deliver to the Contractor the following listed materials in accordance with the Government Furnished Property Clause FAR 52-245-4: (1) All utilities necessary for the Contractor to perform the required services. (2) Card and/or keys necessary to access all areas to be cleaned. (3) Paper products including toilet paper, paper towels, sanitary can liners, and toilet seat covers. (4) Biopreferred garbage bags. (5) Dumpsters for refuse removal. (6) Storage space for Contractor's expendable supplies, tools, and equipment (7) Containers for recyclable material CONTRACTOR-FURNISHED PROPERTY: The Contractor shall furnish: (1) All necessary supplies and materials (including biobased cleaning supplies, kitchen sponges, biobased cleaning solutions, biobased floor polish, biobased carpet shampoo for spot cleaning, biobased spot remover, biobased garbage bags) except those items specified as Government-furnished property. (2) All necessary cleaning equipment including but not limited to: scrubbing machine, floor polishing machine, and vacuum cleaner (10 amps or greater). Equipment shall be commercial size and type customarily used by the janitorial profession and capable of handling sand and gravel brought in by boots. Equipment designed for home use will not meet these specifications. (3) All Material Safety Data Sheets (MSDS) for all solutions and chemicals used in the cleaning of these buildings. MSDS's shall be given to the Contracting Officer (COR) during the pre-work meeting. BIOBASED PRODUCTS: This procurement requires the use of biobased products to the extent that such products are reasonably available, meet agency or relevant industry performance standards, and are reasonably priced. Where available, these products should first be acquired from among qualified products that fall under the umbrella of items designated through the Federal Biobased Products Preferred Procurement Program (FB4P). The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, "Strengthening Federal Environmental, Energy and Transportation Management," and the Federal Acquisition Regulation (FAR) to provide bio-based products. The Contractor shall utilize products and material made from biobased materials (e.g.,biobased polishes, biobased cleaning fluids, biobased sanitizers) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR). The following is an example list of products that may be used in this contract for custodial services for which biobased products are available. The list is not all inclusive. In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products. The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes. The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification. The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts. SUPERVISION, SECURITY, AND QUALIFICATIONS Contractor and his employees shall be capable of performing janitorial work. The Contracting Officer may require dismissal from the work of employees whom they deem incompetent, insubordinate or otherwise objectionable, or whose continued employment they deem contrary to the public interest. The Contractor shall provide adequate supervision of crew to prevent employees from disturbing papers on desks, opening drawers or cabinets, or using telephones provided for official Government use. The Contractor or employees shall not bring children to the premises while the work is being performed. The Contractor must provide security comparable to the type of protection given by commercial or business enterprises to prevent illegal entry into or loitering on the premises; to prevent loss by pilferage or theft; and to admit to the space during off-duty hours only those who are authorized to enter. The use of Government property or services such as telephones, calculators, typewriters, office supplies, etc. for other than official Government business is strictly prohibited. The Contractor shall provide a list of employees authorized to work under this contract. The list shall be submitted prior to employees working on the facilities. FAR 52.204-9, Personal Identity Verification of Contractor Personnel, is incorporated when contract performance requires contractors to have routine physical access to a Federally-controlled facility. Compliance with the provisions of 452.204-71 Personal Identity Verificaton of Contractor Employees (OCT2007) will be required for this acquisition in order to maintain consistence with customary commercial practices. SAFETY Contractor shall submit a safety plan to the Contracting Officer, in compliance with the Occupational Safety and Health Administration (OSHA). A safety plan shall be submitted at the time of the post award meeting. PUBLIC USE These facilities are available to the public outside of business hours. Upon occasion the Contractor may be working in the building when the public is present. The Contractor must secure the non-public areas if both the public and the Contractor are present at the same time. TECHNICAL SPECIFICATIONS TIME OF PERFORMANCE: Supervisor's Office, Garage/Warehouse: All regular services shall be performed between the hours of 5 a.m. through 6:30 a.m. Wednesday and 6: 00 p.m. through 11:00 PM Wednesday and after 6:00 p.m. on Friday and before 6:00 a.m. Monday, unless otherwise approved by the Contracting Officer. As needed services shall be performed a minimum of twice per year. Work may be performed anytime on Federal holidays or weekends. Aviation/Dispatch Facility: For the months January 1 through May 31, and October 1 through December 31, all regular services shall be performed once a week between the hours of 6:00 p.m. on Friday and before 6:00 a.m. Monday. As needed services shall be performed a minimum of twice per year. Aviation/Dispatch Facility: For the months June through September, all regular services shall be performed twice a week between the hours of 5 a.m. through 6:30 a.m. Wednesday or 6: 00 p.m. through 11:00 PM Wednesday, and once a week after 6:00 p.m. on Friday and before 6:00 a.m. Monday. As needed services shall be performed a minimum of twice per year. Contractor will be expected to maintain the areas defined in the Description and Location section, in a professionally clean condition throughout the contract period. DESCRIPTION OF WORK - REGULAR CLEANING RESTROOMS: -Scour toilets, urinals, sinks, showers, and sink tops -Sanitize and remove stains, including rust encrustations and water rings from water closets and urinals. -Wet mop floors, paying particular attention to areas around stools. -Damp wipe partitions -Clean spots on walls. -Empty trash receptacles and other trash and dispose of by dumping in dumpster and replace liners as needed. -Damp wipe and polish dry all mirrors, dispensers, chrome fixtures, shelving, etc. -Maintain adequate supplies of toilet paper, paper towels, and soap. -Replace deodorant dispensers as needed. -Sanitary napkin disposal bags shall be changed on each scheduled cleaning day. OFFICES, RECEPTION AREA, STORAGE AREAS AND CONFERENCE ROOMS: ***DO NOT CLEAN ANY COMPUTER, PHONE, OR AUDIO VISUAL EQUIPMENT*** -Check and turn off all portable personal heaters and fans in the building. -Empty wastebaskets and collect any other trash identified and dispose of in dumpster. Replace liners as needed. -Vacuum all rug areas, including edges and corners, without moving furniture, except for chairs, to reach under desks and tables. -Clean-up scraps around all paper cutters. -Damp mop tile floors using neutral cleanser in proper solution to remove dirt and scuff marks without disturbing waxed surface, restore luster to wax, and remove splash spots from mopboards and walls. Tile is no-wax type. -Damp wipe inside of wastebaskets as needed. -Wash tops of tables without disturbing papers. -Dust and damp wipe all visible surfaces such as shelving, cabinets, furniture, door frames, window sills, wainscoating, fixtures, vents and chairs. -Polish wood table in Forest Supervisor Office with wood polish. -Wash and clean cement floors in garage-shop. -Bundle recycle paper, and deposit into recycling container -Remove all cardboard, flatten, bundle and deposit into recycling container. -Lids on dumpsters must be kept closed. -When garbage in dumpsters doesn't allow for lid to close - please notify the Contracting Officer's Representative as soon as possible. KITCHEN, COFFEE/LUNCH ROOM, FITNESS ROOM, SINK AREAS, AND DRINKING FOUNTAINS: -Vacuum all rug areas, including edges and corners. -Scrub, to remove stains and mineral deposits, disinfect and polish, dry all sinks. -Damp wipe counters and tables. -Spot remove stained areas. -Maintain adequate supplies of paper towels. -Replace kitchen sponge as necessary, at least once per month. LOBBY, CORRIDORS, VESTIBULE, AND FOYER: -Vacuum/sweep all areas including edges and corners. -Vacuum walk-offs mats. -Wash both sides of windows in main front door except during periods of freezing weather, then only inside windows. EXTERIOR ENTRANCES AND WALKWAYS: -Remove debris from entry walkways. -Sweep outside entry walkways to remove dirt, litter, and cobwebs. -Empty trash/ash tray and clean as needed. DESCRIPTION OF WORK - MONTHLY : -Spot-clean all surfaces to remove marks, smudges, fingerprints, and spots from walls, window casings, woodwork, glass surfaces, and door jambs. -Remove all cobwebs from walls, corners, and ceilings. -Wash and clean exhaust vents. -Vacuum or dust all surfaces to remove cobwebs and dust, including venetian blinds. -Dust window sills and frames. -Remove stains from all carpets in the building with recommended spot remover. -Perform other services as necessary to keep the space in a clean and sanitary condition. AS NEEDED: -Change light bulbs and replace with same type and wash light cover at same time. Notify COR in writing if it appears that the light ballasts need replacing. Notify COR when fluorescent light supply is low. CONTRACTOR QUALITY CONTROL The Contractor is responsible for management and quality control actions to meet the terms of this contract. The Contractor shall provide a site specific quality control plan as part of your offer. Records of quality inspections shall be kept and made available to the Government throughout the performance. A description of the quality control plan shall include security procedures for any Government-provided items such as keys or lock combinations, location of the documented inspections, and corrective or preventive actions taken for unsatisfactory performance. GOVERNMENT QUALITY ASSURANCE Quality Assurance will be performed randomly by the Government during the contract period. Methods may include visual survey, review of customer complaints, and review of Contractor quality control documents. Deduction for work not performed will be made as follows: • See Attachment C - Quality Assurance Surveilance Plan QUALITY ASSURANCE INSPECTIONS (1) The Government will perform periodic review of the Contractor's Quality Control Procedures, Plan, Inspections Reports, and customer comments. (2) Quality Assurance Inspections will be made by random sampling or entire inspection of the work, and follow up of customer comments. When validating customer comments, the possible cause of unacceptable performance will be determined. If any Government action or lack of action was the cause, the complaint is not valid and deficiencies shall not be counted against the Contractor. (3) Periodic means one (1) review each month, but may be done more frequently if necessary. (4) Work that does not meet the contract requirements will be brought to the Contractor's attention. Repetitive or continuous failure to meet contract requirements may result in a quality adjustment to payment of the Contractor's right to proceed may be terminated. PAYMENT (1) Payment will be made monthly at the contract price per month. Contract price and payment shall be full compensation for all contract work. (2) Quality adjustments shall be made when work has not been performed according to contract and the Contractor did not or cure nor correct the situation. An example of work that can not be corrected is failure to perform work that is required on a daily basis, such as cleaning bathrooms or emptying trash cans. The adjustment will be determined by totalling work not performed during the payment period and comparing it to the total work scheduled to be performed. If this comparison results in greater than 10% of the work not performed, an equal adjustment will be made. PREWORK CONFERENCE Prior to comencement of work, the Contracting officer will arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. Also at the meeting, such things as work progress schedule shall be established in writing. CONTRACT CLAUSES FAR 52.212-1 --Instructions to Offerors -- Commercial Items (Feb 2012 ) (a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 empoyees. (b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show -- (1) The solicitation number; (2) The time specified in the solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary; (5) Terms of any express warranty; (6) Price and any discount terms; (7) "Remit to" address, if different than mailing address; (8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically); (9) Acknowledgment of Solicitation Amendments; (10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and (11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. (c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. (d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing. (e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately. (f) Late submissions, modifications, revisions, and withdrawals of offers. (1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due. (2) (i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and- (A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or (B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or (C) If this solicitation is a request for proposals, it was the only proposal received. (ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted. (3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel. (4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume. (5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer. (g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received. (End of Provision) FAR 52.212-2 Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: A. Technical: Site specific Quality Control Plan which should include biobased product requirements. B. Past Performance: List of projects completed in the last three years. Please include name of company, contact phone number and overall quality of work performed. C. Price: List prices for Base Year as well as all option years. Past performance and technical expertise, when combined, are slightly less important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. (End of Provision) 52.212-3 Offeror Representations and Certifications-Commercial Items (Apr 2012) An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via https://www.acquisition.gov. (a) Definitions. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). "Sensitive technology"- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. FAR 52.232-19 Availibility Of Funds For The Next Fiscal Year (APR 1984) Funds are not presently available for performance under this contract beyond December 31, 2013. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond December 31,2013, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer. FAR 52.236-7 Permits And Responsibilities (NOV 1991) The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract. AGAR 452.228-71 Insurance Coverage (NOV 1996) Pursuance to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below: (a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational disease are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers. (b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance and shall be required in the amount of $500,000 per occurrence. (c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurence for bodily injury and $20,000 per occurrence for property damage or loss. (d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater. AGAR 452.209 - 71 ASSURANCE REGARDING FELONY CONVICTION OR TAX DELINQUENT STATUS FOR CORPORATE APPLICANTS (FEB 2012) (ALT 1)-DEVIATION (a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it - (1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and (2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government. (b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434. (End of Clause) FAR 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six (6) months. The Contracting Officer may exercise the option by written notice to the Contractor within thirty (30) days. (End of clause) 52.217-9 Option to Extend the Term of the Contract (March 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within thirty (30) days, provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least thirty (30) days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed three (3) years and six (6) months.
