Description
The US Army Contracting Command - New Jersey, Soldier Weapons (ACC-NJ-SW) on behalf of the Office of the Project Manager, Soldier Weapons (PM-SW) has a requirement for up to a total of 350,000 Replacement Bolts used in the conversion of the M4 Carbine to the M4A1 Carbine. To meet continuous requirements for FY13 through FY17, the United States Government intends to award one or more four-year IDIQ contracts with Firm Fixed Price (FFP) orders based on Other Than Full and Open competition to offerors whose proposals provide the "best value" to the Government. The Government intends to award no less than one contract to a Small Business. The Government will select for award the proposal(s) that are most advantageous and meet the best value requirements of the Government. Competition for this requirement shall be other than full and open, and limited to the United States and its territories, island possessions and protectorates, in accordance with the license agreement between the US Government and Colt Defense LLC, limiting distribution of the Technical Data Package (TDP). The authority to limit competition is in accordance with 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(A), only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1(a)(2) applies when supplies or services required by the agency are available from only one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements. The maximum contract ceiling price for the total anticipated contract award is $21,350,000.00. The maximum quantity of units is 350,000. The anticipated award date for this action is 3rd Quarter of Fiscal Year 2013. NOTES: If/when a solicitation is released, the following information is provided for your use in order to obtain the TDP: Once the solicitation is released, interested parties must mail/email a signed and approved DD Form 2345 Military Critical Technical Data Agreement along with a completed and signed AMSTA-AR Form 1350 Technical Data Request Questionnaire, and a completed and signed U.S. Government Non-Disclosure / Non-Use Agreement (forms included in solicitation documents). A copy of the companys State/Provincial Business License, Incorporation Certificate, Sales Tax Identification Form or other documentation which verifies the legitimacy of the company must accompany the DD Form 2345. PLEASE NOTE, THE TDP IS NOT AVAILABLE AT THIS TIME. THE TDP WILL BE AVAILABLE ONLY AFTER THE RELEASE OF THE A FULL SOLICITATION. Note 1: The TDP for the M4A1 Replacement Bolt will be marked Limited Distribution D, distribution authorized to the Department of Defense (DoD) and its DoD contractors only. This TDP contains technical data whose export is restricted by the Arms Export Control Act (Title 22. U.S.C., Sec 2751, et seq.) or the Export Administration Act of 1979 (Title 50, U.S.C., App. 2401 et seq.), as amended. Violators of these export laws are subject to severe criminal penalties. Note 2: DD Form 1350: Question 5 obtaining an ITAR number from the United States Department of State. This is necessary for any company that will be manufacturing DoD equipment even if such items are not being exported out of the country. Please note that this notice does not constitute a Request For Proposal (RFP). All responsible sources may submit a capability statement, proposal, or quotation, which will be considered by the Government following the release of an official solicitation. This notice is not a solicitation and does not obligate the Government to issue a solicitation, nor will the Government be liable for any costs involved for submission of information in response to this notice. Release of an official solicitation is anticipated to occur in early January 2013. Interested parties are encouraged to monitor FedBizOpps for the release of the solicitation.
