- Per FAR 7.3 and OMB Circular A-76, the Department of Veterans Affairs' (VA) Strategic Acquisition Center (SAC) is issuing this sources sought synopsis as a means of conducting market research to identify qualified contractors with the capability and the resources to meet the VA Pharmacy Benefits Management (PBM) Service's requirement for a consumer returnable medication process. The requirement is to implement a program that provides a mechanism for patients to return unused, unneeded medications from their home using a secure method to a vendor for proper disposal. The result of this market research will contribute to determining the method of procurement. Based on the information gathered from this RFI, a determination shall be made by the contracting officer, if a solicitation is issued, of the most applicable NAICS code. At this time the suggested North American Industry Classification System (NAICS) codes assigned to this procurement are 562211 or 562213. Consumer Return Medication Envelope or Equivalent process The Department of Veterans Affairs (VA) is in need of a vendor who can provide consumer return medication envelopes or equivalent with a turn-key approach which includes the delivery, postage, processing, advertising, reporting, and EPA approved method of destruction of Consumer Return Medication Envelopes or equivalent and their contents. The turn-key approach must meet the Veterans Health Administration (VHA) procedures for shipping and privacy of the Veterans' information (per HIPPA, EPA, DEA and all other Federal and State regulations). The objective of this effort is to provide a safe and responsible mechanism for veterans to dispose of unneeded, non-controlled substance medication(s) in order to enhance medication safety in the Veteran's home and prevent harmful absorption of medication in the environment. The contractor must be able to meet the following requirements: a) Supply pre-addressed and postage-paid envelopes or equivalent to the government. b) Carrier shall show proof they offer accessible mail service comparable or better to USPS for customer convenience, including pick-up from homes in rural and remote areas, within all fifty (50) US states, District of Columbia and US territories (all US territories and possessions are considered "domestic mail" by the USPS). c) Each envelope or equivalent process shall include a unique bar-code for tracking, weight, and destruction. d) The Contractor shall provide a procedure for examining packages for evidence of tampering and shall provide to the Government those procedures which shall be followed in response to such situations. e) The Contractor shall VA "brand" the instruction for use sheet or equivalent contained inside each envelope or equivalent, per VA approval. f) The Contractor shall use destruction methods that are in compliance with all applicable Environmental Protection Agency (EPA) and local State regulations for destruction of household consumer pharmaceuticals. The Resource Conservation and Recovery Act (RCRA) is a federal law controlling the management and disposal of solid and hazardous wastes produced by a wide variety of industries and sources. The RCRA program regulates the management and disposal of hazardous pharmaceutical wastes produced by pharmaceutical manufacturers and the health care industry. It does not regulate household pharmaceutical waste. The EPA issued a memo in Sept 2012 which provided recommendations for the disposal of household pharmaceuticals collected through take back or mail programs. This memo is available at: http://www.epa.gov/osw/hazard/generation/pharmaceuticals/pharms-take-back-disposal.pdf. g) All packaging received from Veteran shall remain sealed throughout the handling process, with the understanding that it shall be properly disposed of, at a minimum, utilize one of the following methods for destruction of all consumer pharmaceuticals: Permitted Hazardous Waste combustor, Large Municipal Waste Combustor, or Small Municipal Waste Combustor and the preferred method for disposal will be Waste-to-Energy plants and be non-retrievable and non-recognizable at the end of the destruction process. h) The Contractor shall propose a plan to advertise to the Veteran and staff the consumer return program which shall be approved by the Pharmacy Benefits Management (PBM) Services. At a minimum advertisement shall be provided at 200 locations. Advertisement may include but are not limited to the following: posters advertising the program; introductory letter from the company to the staff about the program; cardboard desk stand-up signs advertising the program; bag stuffers advertising the program; and, Portable Document Format (pdf) file so facilities can print if additional supply is needed. i) The contractor will, use barcodes or equivalent, track and report number of envelopes or equivalent distributed to each station, number of envelopes or equivalent received back to vendor, weight of each envelope or equivalent and percentage received against percentage issued and make this data available in aggregate (national or VISN) and by station on a virtual dashboard or equivalent that can be accessed by at least 200 VA users. The contractor will provide the capabilities for VA staff to input the barcodes or equivalent shipped to each station and for VA staff to generate reports by specific date range as well as "all time". The report will also list any envelopes or equivalent showing signs of tampering and results of investigation. j) The contractor must be able to supply product, proof of all necessary permits, approval, reporting/tracking system and advertising products within 60 days of contract award. THERE IS NO SOLICITATION AT THIS TIME. This market research is issued for information and planning purposes only and does not constitute a solicitation nor does it restrict the Government as to the ultimate acquisition approach. This request for capability information does not constitute a request for proposals; submission of any information in response to this market survey is purely voluntary; the government assumes no financial responsibility for any costs incurred. In accordance with FAR 15.201 (e), RFIs may be used when the Government does not presently intend to award a contract, but wants to obtain price, delivery, other market information, or capabilities for planning purposes. Responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. If your organization has the potential capability to perform this effort, please provide the following information: 1) Organization name, address, email address, website address, DUNS number, telephone number, size and type of ownership for the organization, business size (i.e. large business, small business, service disabled veteran owned small business, veteran owned small business, woman owned small business); 2) Tailored capability statements addressing the particulars of this effort; 3) Documentation showing method of shipping is approved by carrier (currently the United States Postal Service); 4.) If applicable, a copy of previous contracts identifying your company performing this effort with another company/organization. If significant subcontracting or teaming is anticipated in order to deliver technical capability, organizations should address the administrative and management structure of such arrangements; 5) Estimated price for to meet the requirement. The government will evaluate market information to ascertain potential market capacity to: 1) provide the effort consistent in scope and scale with those described in this notice and otherwise anticipated; 2) secure and apply the full range of corporate financial, human capital, and technical resources required to successfully perform similar requirements; and, 3) implement a successful project management plan that includes: compliance with delivery schedules; and meeting the rigid listed specifications.
