Description
This is a combined Synopsis / Solicitation / Notice of Intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested and a written solicitation will not be issued for the solicitation number NIAID-NOI-13C-1611725 a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC2005-61 dated October 15, 2012. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside, however small disadvantage, minority, veteran owned, and HUB zone companies are encourage to submit proposal. The associated North American Industry Classification System (NAICS) Code is 325414, which has a small-business size standard of 500 employees. The National Institute of Allergy and Infectious Diseases (NIAID) intend to procure human cell reagent on a sole source basis with Stemcell Technologies. Item/Description/Quantity: EasySep Human CD4+ T Cell Enrichment, #19052, qty-84. This particular human cell reagent is needed for use with the RoboSep instrument already located in the lab. Stemcell Technologies is the sole manufacture of the instrument that allows researches to maintain exceptional consistency and highly reproducible scientific results on samples related to the investigation of HIV/AIDS and the human immune system. The lab is needed to maintain the continuity of the following protocol #Z-A1000851-05, The Role of Viral Reservoirs in Pathogenesis of HIV Disease, which testing is being performed on-going in the lab. Changing variables at this time would result in incorrect interpretation of the protocol listed. The following factors shall be used to evaluate offers: 1) capability to meet required specifications 2) price, and 3) delivery (15 days after receipt of award) to Bethesda, Maryland 20892. The government will award a fixed price purchase order to the responsible contractor. The FOB terms are 'Destination' and Net 30. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1 Instructions to Offerors Commercial Items; FAR 52.212-2 Evaluation - Commercial Items; Far 52.212-3 Offeror Representation and Certifications Commercial Items; Far 52.212-4 Contract Terms and Conditions Commercial Items; Far 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items; and FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003). A completed copy of provisions at FAR 52.212-3 Offerors Representation and Certifications Commercial Items must be included which can be found online at System for Award Management (SAM) https://www.sam.gov. By submission of an offer, the Offeror acknowledges the requirement that a prospective Awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. [Note: Lack of registration in SAM will make an Offeror ineligible for award.] All responsible sources may submit an offer that will be considered by the Agency. Offers must be submitted no later than 5:00 P.M. Eastern Standard Time on November 26, 2012 through the Postal Service, at the address of NIH/NIAID/AMOB, 10401 Fernwood Drive, Room 2NE52D, MSC 4811, Bethesda, Maryland 20892-4811.
