- Notice Type: Notice of Intent - Sole Source *This notice of intent is not a solicitation. Background: The National Instruments LabView Full Development System (FDS) Enterprise License Agreement allows NIST staff unlimited access to LabView FDS for Windows PC, Mac and Linux for as many seats as needed by NIST. These seats are distributed as computer or user based, and licenses through the National Instruments TMS Volume License Manager (VLM). The current agreement that NIST holds with National Instruments Corporation expires on February 12, 2013. Synopsis: The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the NIST Office of Information Systems Management, intends to negotiate with National Instruments Corporation; Austin, TX, on a sole source basis under the authority of FAR 6.302, to provide the purchase/renewal of the National Instruments LabVIEW Full Development System (FDS) Enterprise License Agreement. The Enterprise License Agreement allows researchers at Gaithersburg and Boulder campus unlimited access to the software for multiple operating system platforms. The Enterprise license Agreement provides version updates for all copies of LabVIEW Full Development System (LV-FDS) owned by NIST. Premier telephone technical support, upgrades and installation of new copies of software, discount training, free on-line training, and vouchers for advanced National Instruments classes are also included as part of the support agreement. The continued maintenance access to the National Instruments software version updates, support, installation services and training are critical to several projects that are continuously conducted across multiple organizational units within NIST. In order for these projects to continue without interruption, it is essential that these software licenses be updated and that NIST continue to receive access to the aforementioned benefits and services. The period of performance of this planned requirement is expected to be for a base period of one year, followed by two option periods of one year each. The period of performance is expected to begin on February 13, 2013. National Instruments Corporation is the sole source of this requirement, and does not have any authorized resellers/business partners that are authorized to provide this Enterprise License Agreement. This requirement includes the following items: Line Item No. 1 Base Period: 02/13/2013 - 02/12/2014 Part Number: 778367A-01 Enterprise Agreement including software and training credits Line Item No. 2 Option Period 1: 02/13/2014 - 02/12/2015 Part Number: 778367A-01 Enterprise Agreement including software and training credits Line Item No. 3 Option Period 2: 02/13/2015 - 02/12/2016 Part Number: 778367A-01 Enterprise Agreement including software and training credits The NAICS Code is 511210 with a Size Standard of $25.0 million. NIST anticipates negotiating and awarding a firm-fixed-price contract to National Instruments Corporation for this requirement. The following standards of Section 508 of the Rehabilitation Act of 1973 apply here: 1194.21 1194.31 1194.41 Interested parties that believe they could satisfy the requirements listed above for NIST and are authorized to provide these services may clearly and unambiguously identify their capability to do so in writing on or before November 16, 2012 at 10:00 AM Eastern Standard Time. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
